GOSSIP OF THE TURF TURFThe Tufted The question of liability for forfeits against James E Pepper for which the horses entered and running in the name of E O Pepper are claimed to ba liable has come up recently Colonel L P Tarleton Carleton presiding judge of the Queen City Jockey Club after an exhaustive examination into the matter has decided that the horses running in the name of E O Pepper are not liable for such forfeits Colonel Pepper being insolvent conveyed all his property to the Lexington Trust Qompanyta Company hedisposed heists of by it for the benefit of his creditors The trust company in administering the trust sold all the horses belonging to James E Pepper at public auction at which E O Pepper his wife purchased those now running in her name paid for them and now owns and holds them as her property all of which is by the Kentucky statutes within her clear legal right There was no evidence that the transfer of said horses to Mrs Pepper was for the purpose of avoiding the payment of forfeits The transfer of the horses was not made by Colonel Pepper but by the trust company from which Mrs Pepper ac ¬ quired quirked her title Cincinnati Enquirer Notes Of The Turf.
