By-Law XVI changed so as to provide for an assistant secretary. By-Law XIX changed by adding the words "through the secretary" after the word "Congress" in seventh line. Rule No. 6 was stricken out. Rulo No. 17 was changed to read as follows : The colors solected by owners must be registered with the Secretary of the Congress and when thus registered shall not be used by others except in case of death or after five years' withdrawal from the turf. Any owner racing in colors not registered shall be fined. A fee of $1.00 shall bo charged for registering and the Secretary shall issue a certificate of registration. In case of conflicting claims those now registered with tho Secretary shaU have prior claim. A list of colors that have been registered shall be furnished each member by tho Secretary of tho Congress and shall bo posted in the office of tho Clerk of the Scales. Rule 18 Every person or horse expelled or ruled off by any reputable running association, or by the American or tho National Trotting Association, shall stand ruled off the courses of the members of this Congress during the continuance of such expulsion. Any Association that shall knowingly allow any rulod-off or expelled person or horse to participate in its racing shall be outlawed. Rulo 27 Any owner, trainer, jockey or horse, that shall in any way participate in racing under injunction proceedings, or any owner, trainer or jockey that shall attempt to nullify by legal process the rulings of officials in caso of fraud shall be barred from all privileges of the tracks of tills Congress. This rule to take effect from date of passage. Rule 95 Declarations in purse races must bo made by the owner, trainer or other person deputed by him, to the Secretary or his assistant by 12 o'clock (noon) of the day of the race, or at such othor time as he may appoint. When a party having more than one horse entered in a nurse, shall dnclnrn onn nnt , thereby declares all out, but this rule shall not apply to handicaps. Declarations in purse races must be accompanied by five (5) per cent, of the first money. In purso races with more than eight entries, owners can declare out to that number free of charge, the right to declare free being determined by lot, as occasion may require. All declaration fees in purse races shall go; 60 per cent, to second horse and 40 per cent, to third horse. In caso ono horse distances tho field in heat races, all entrance and declaration money must go with the purse. Rule 105 No jockey, oxcept when riding for his contract employer, shall be weighed out for any race unless there has been depositod for him with the Clork of the Scales the fee for a losing mount in that race, and the Clerk of the Scales shall Loop the accounts for the jockeys, pay over to them the money collected, unless he has notice to the contrary, and for his services shall receive two por cent, of the amount collected. Tho failure to deposit this fee for the jockey engaged for any horse shall declare it out of tho raco. Rule 157 Stricken out. Rule 160 In selling races the horse's engage- ments are included if the horse is boug or claimo Rulo 172 Owners and trainers employing ' riders, grooms or attendants shall make their contracts in writing, properly signed and wit- ; nessed, whenever he time covered by the con- : tract exceeds thirty days. Any person who shall entice or attempt to entice away from an ; employer, a rider, groom or attendant who is under contract, may be fined or ruled off. No contract shall be bindintr under thcso rules, the provisions of which give an omployor any interest whatever in tho earnings of a jockey, and the License Committee shall grant no licenso to jockeys bound by such contracts. Any employer or jockey misrepresenting the terms of any contract shall be ruled off. In the absence of written agreement the engagement of a jockey, groom or attendant terminates with the last day of oach month. If a jockey, groom or attendant be prevented from riding or service by suspension for fraudulent practices or 01 her misconduct, any person who has retained or employed him may cancel the contract or retainer. In like cases, if any owner or trainer be prevented from running or training by suspension for fraudulent practices or other misconduct, the rider, groom or attendant may cancel the contract or retainer. Rule 176 Jockey fee is fixed at 25. Rule 178 If a jockey engaged for a certain raco, or for a specified time, refuses to fulfill an engagement, the Judges shall fine or suspend , him. Rule 19 Stccplechasos stricken out. It is a duplicate. Tho following new Rulo was adopted: No person against whom there are outstanding forfeit orders or other arrears issued by members of the Congress shall receive a trainer's or jockey's license until the same are paid. The following new Rule was passed: Any person who shall enter or run a horse or allow a horse to be entered in a selling raco while any claim is held against such horse, either as a bill of sale, chattle mortgage or lien of any nature, by anyone, without making the fact known at tho time of entry shall bo considered guilty of fraud and shall immediately be ruled off by the Judges, and any and all persons claiming title or ownership of any horse after such horse has run in the name of another person, having peaceable and undisturbed possession of same, shall be considered guilty of fraud and bo ruled off by the operation of this rulo. This rule to take effect immediately. Messrs. Tarlton, Fowler and Hopper were appointed committee to edit rules. The name of the Chicago Racing Association was changed on the records to the Chicago Jockey Club. L. D. Hall, James Arthur and J. R. Hand, who participated in racing at Woodstock, 111., run contrary to American Racing Rules, were reinstated. Tho horses, Barrier and Ramona, were refused reinstatement. The mare Maxino, formerly Flour de Lis, whose name was changed East to conform to their registration rule, was permitted to run undor the name of Maxino on Congress tracks. The following resolution was adopted: Inasmuch as the fund of the Turf Congress has accumulated beyond all possible future necessities, and as the fixed revenues are ample for annual expenses, Resolved, That tho Congress appropriate to each of its members the sum of '$1,000, or as much thereof as the different clubs may designate, to which a like amount shall be added by each club, to be known as the Turf Congress Sweepstakes of 1900, and to be run in one or moro stakes as oach club may provide. Of the sum appropriated one-half shall be paid to the trainers and jockeys of the three placed horses, as follows : Forty per cent., 20 per cent, and 10 per cent, to the trainers of tho first, second and third horses respectively, and 15 per . cent., 10 per cent, and 5 per cent, respectively to the jockeys riding them. And when anyAsso ciation shall show to the satisfaction of the . ;Secretary of the Congress that the above stake has been given and that its conditions have i boon complied with in full, he shall authorize the Treasurer of the Congress to pay over to 1 f. each one complying the requisite amounts. Tho time for forfeiture of membership on account of not giving a meeting within tho year ' was extended to September 1, 1900. The registration rule was amended so as to conform to the rule governing the Stud Book, except that portion of tho Stud Book rule relating . to the naming of foals. Monday was m irked by an exceptionally fine afternoon and the loy3r3 of the sport of kings turned out at Harlem in fall force. The track was at its best and fast time was the rnle. Fred Foster's handaome Watercress Paloma 310,000 teauty Yellow Tall stepped five furlongs in 59i, establishing a new track record and incidentally winning a big bet for his owner. Yellow Tail was in the fifth event along with an ordinary lot of youngsters, and opening at 3 to 2, he was hurriedly backed down to 6 to 5, going to the post a stanch favorite. McQaade rode Yellow Tail, and getting off in front, he made a runaway race of it. Inlook stayed with the Foster colt through the first furlong, which was run in 11, and then he collapsed, letting Yellow Tail open up a big gap and win running. Mc-Quade took no chances and at the finish was riding the colt, although he was about a half dozen lengths in the lead. Fat Dunne's Salvable, who, so rumor had it, -was hopelessly broken down, recovered with a start and won the mile and seventy yards con-dition race in a high class way and in almost track record timo. The handsome son of oal--vator Lydia, sent to the po3t thickly bandaged in front, was heavily backed. Master Tommy Burns was np and he rcda one of bis bast judged rattas. He broke third with Salv-able and remained in that position to the three-eighths post, then he cut loose and set sail for tiia flying pacemaker, Found. The latter as in fine fettle and it took Salvable'a best speed to catch her, and when he did the filly hung on like glue. It was about the sixteenth post when the pair hitched up and from there to the wire they had it hammer and tongs. Found aievar was very stoat-herted and in the last iew strides she hung and Salvable got the verdict by a nose. Foand stepped the first mile in 1:39. That J. H. (Texas) Smith is on the alert about the chances of the sellirg race game was clearly demonstrated after the second event. He has been after Jackanapes for some time, and after he was beaten in the race mentioned, Mr. Smith claimed him for $900. Once before at Hawthorne Smith ran Jackanapes up after he liad won to $1,200, but Johnny Schorr who had him theji kept him. This considered, Smith got quite a bargain. Doable Dummy at the false price of 6 to 1, won the race marked by this incident, very easily. There were big fields in the first and third races, and they were to a certain extent decided at the start. Mont Eagle, at 7 to 1, and Jim Gore II., at 4 to 1, proved to ba the fortunate ones, and, after getting off in front, were good enough to hold their lead and land their respec ive races. Tommy Barns rode a perfect race on Jimp in the closing mile selling event and won, driving and all out. by about a length from Yolandies. Jimp is a peculiar horse to ride and Burns has him down to perfection. He has just one burst of speed and after that is exhausted he is through. Burns knows this well and took particular painB to use that burst of speed at the right time. The Lake street elevated famishes comfortable transportation going out to Harlem, but the returning trains are badly managed. Last evening the first two trains leaving the track -ware not half filled, but the last one was crowded to the limit and standing room was at a premium. Mr. Condon said last night that he would turn special attention to this feature and the chances are that there will be seats for all returning late hereafter. T. Barns, J. W. Appeals Decided APPEALS DECIDED. The Committee on Appeals of tho American Turf Congross has rendered the following decisions in cases appealed from various members of the Turf Congress. The most important case is that affecting jockey Rose and employer W. Clancy. The decision is as follows :. In the controversy betweon J. J. Smith and W. Clancj over tho services of tho boy Leo Hose, the committee rendered the following opinion : "In the case of tho jockey Lee Andrew Rose, we are of the opinion ttiat J. J. Smith is legally entitled to his services, and it is ordered that W. Clancy bo fined $100 and relinquish his claim upon the boy; and it is further ordered that the jockey Roso be notified to at once return to the service of J. J. Smith." At the spring meeting of the Louisville Jockey Club W. Gallagher, part owner of the b. c, Patroon, 4 year-old, by Patron Madie, entered said horse in a race to bo run on May 4th, and after time to declare Gallagher requested the judges, C. F. Price and L. P. Tarlton, to excuse the horse. After an examination of the horse and being fully satisfied that he was not lame, as claimed by Gallagher, the judges ordered Gallagher to start the horse. Gallagher rofusad to do so and the judges ruled Gallagher and tho horso off. The Committee on Appeals sustained ihe judges. In the controve-sy between F. M.Arthur and the Queen City Jockey Club over the payment of entrance fees, the committee decided that tho Queon City Jockoy Cluo was entitled to the $65 held by the Chicago Racing Association. Since moEt of the eastern jockeys have been suspended the western boys have been scoring quite a success. Jenkins and Bullman seem to be the stars of the western division. JeDkins won three races the other day and was placed in two others. Bullman won two races also and the odd one went to that young artist, Wilson. Odom seems to have gone back a bit or else he isnotgettitg as good mounts as he used to. The youngster has been a bit timid since his fall and perhaps owners are not willing to take chances on him. Spencer is not in very good form, and O'Leary seems to be riding poorly. Nothing sncceeds like success, and since Jenkins and Bullman have ridden one or two good races there is a rush to secure their services. Luck is an important factor in races and turfmen are proverbially superstitions. All jockeys have their streaks of luck. There was a time at Saratoga when Sloan, the master of them all, with his choice of mounts selected by competent advisers, rode in fourteen or more races without scoring a win. Maher had a loDg losing streak of twenty oddraces at Graveeend last fall. Bullman, when he made his first appearance here, not only rode badly, bnt seemed unable to get away from the post except in the tail end division. Jenkins was not thought much of on his first appearance. But Jenkins and Bull-man have run' into a streak of Inck and they will be public idols as long as it lasts. As horeeman they are outclassed by Spencer, Odom and one or two others who are riding, but luck carries the day. New York World. Flying Fox has this year won $187,075 in his six races, and should he come out fresh and well next season Buch valuable stakes are apparently at his mercy that the aggregate winnings of Isinglass ana Donovan bio. fair to be thrown completely in the shade. Flying Fox's total winnings in 1898 and 1899 reach $200,480. Isinglass won $287,375 in his three turf seaEonB of 1893, 1894 and 1895. while Donovan won $275,772.50 in 1888 and 1889. Flying Fox's engagements for next year include no less than four races of $50,000 each', namely, the renewal of the Princess of Wales, Eclipse and Jockey Club, each for three-year-olds and four-year-olds, together with the new event, the Century Stakes, at Sandown Park, which is run in the spring and is exclusively for four-year-olds and five-year-olds. Flying Fox is also in the Rons Memorial and Hardwick at Ascot, and has, therefore, to win less than one-half of his engagements in order to pass Iain-glass' record. He was bumped about considerably down the back stretch and pocketed numerous times in tbe last quarter. Tenole had no excuses. He was off well, had clear sailing but could not last.
