Royal Rival is a grandly bred one that as yet has not started, Advance consideration of two-year-old events is always fascinating to dyed in-the-wool stndentB of racing problems. Each young thing has before it the possibility of reigning as a "king" or ' queen" of the track until the rude test of actual racing dispels illusions and reveals those destined to equine greatness. Tomlinson & Co. own a well known and good three-year-old colt called The Conqueror. Col. W. 8. Barnes owns a two-year-old colt, by Jim Gore— Bacchante, that is also named The Conqueror. Prima facie it would appear that Tomlinson'a colt would have the prior right to the name because of his being a year oldar, bat such does not seem to be the case. Colonel Barnes was written to about the matter, and in reply aaya : "The name of The Conqueror I claimed and had registered when my colt was a weanling. When I selected that name and had it duly registered with the Jockey Club, I had never heard of Mr. Tomlinaon's colt. Aa soon aa I saw that Tomlinson was running a colt under that name, I wrote to the Jockey Club and called their attention to the fact, and they replied promptly saying: 'You are the only one that haa registered this name for a colt, and Mr. Tomlinson'a colt has never had a name claim 3d and registered with us, and you alone are entitled to the name.' "I then wrote to Tomlinson and told him all these facts, and said to him in this letter that I cared nothing whatever for the name and urged him to registar a name for hia co t and that he would not be eligible to race in the east unless he did do so, I told him I would gladly allow him to retain the name— Tbe Conqueror — provided be could so arrange it with the J is key Club and would pay the cost of changing my colt's name, which would bi $100 Mr. Tomlinson replied by saying he had left th, matter of registering and naming the colt with a gentleman in New Orleans, and if I remember correctly, be said the man waa his partner in the ownership of the colt and that he wis of the opinion that the colt had had a name registered and would refer the matter to his partner. "As I was, and am, clearly entitled to the name I could not be expected to pay for changing my colt's name ($100) and still car i nothing for it. They have not accepted my proposition, which was certainly a very liberal one on my part. I tried to right the matter and am sorry that I selected this name. His colt la truly a conqueror and the name should ba retainel by Tomlinson if he can arrange it and pay for doing so." This communication brings up a decidedly interesting question for the consideration of Messrs. Tomlineon & Co. Their colt is heavily engaged and considered to havs a fine chance of taking high rank as a Derby winner. Yet it is doubtful if he haa a right to start in any stake for which he has been nominated. Clause 7 of rule 23 of American Racing Rules says : "No horse foaled ia the United States since January 1, 1892, and no foreign-bred horse imported into the United Statea or Canada since January 1, 1900, shall b3 allowed to start in any fl it race unless it has been named and registered aa by this rule provided." If Tomlinson's colt has not be?n registered since the correspondence with Colonel Barnes it seems that the above rule absolutely bars bim from racing until hia disqualification ahall have been removed, It is a gravely important case and one that signally illustrates the groaa carelessness of many owners and trainers in failing to inform themselves of the laws governing their calling. J. DYMENT SUSPENDED. New Orleans, January 19.— The stewards, after investigating the running of Fred Perkins, recommend the suspension of Trainer J. Dyment and the horae Fred Perkins from all privilegea indefinitely and further recommend that the entries ef other horses from this stable be refnsed for tbe remainder of the meeting. By-Law XIX changed by adding the words "through the secretary" after the word "Congress" in seventh line. Rule No. 6 was stricken out. Rule No. IT was changed to read as follows : The colors selected by owners must be registered with the Secretary of the Congress and when thus registered shall not be used by others except in case of death or after five years' withdrawal from the turf. Any owner racing in colors not registered shall be fined. A fee of $1.00 shaU be charged for registering and the Secretary shall issue a certificate of registration. In case of conflicting claims those now registered with the Secretary shall have prior claim. A list of colors that have been registered shall be furnished each member by the Secretary of the Congress and shall be posted in the office of the Clerk of the Scales. Rule 18 — Every person or horse expelled or ruled off by any reputable running association, or by the American or the National Trotting Association, shall stand ruled off the courses of the members of this Congress during the continuance of such expulsion. Any Association that shall knowingly allow any ruled-off or expelled person or horse to participate in its racing shall be outlawed. Rule 27— Any owner, trainer, jockey or horse, that shall in any way participate in racing under injunction proceedings, or any owner, trainer or jockey that shall attempt to nullify by legal process the rulings of officials in case of fraud shall be barred from all privileges of ' the tracks of this Congress. This rule to take effect from date of passage. Rule 95— Declarations in purse races must be made by the owner, trainer or other person deputed by him, to the Secretary or his assistant by 12 o'clock (noon) of the day of the race, or at such other time as he may appoint. When a party having: more than ome horsa entered in a purse, shall declare one out, he thereby declares au out, but tins role snail not apply to handicaps. Declarations in purse races must be accompanied by five (5) per cent, of the first money. In purse races with more than eight entries, owners can declare out to that number free of charge, the right to declare free being determined by lot, as occasion may require. All declaration fees in purse races shall go ; 60 per cent, to second horse and 40 per cent, to third horse. In case one horse distances the field in heat races, all entrance and declaration money must go with the purse. Rule 105— No jockey, except when riding for his contract employer, shall be weighed out for any race unless there has been deposited for him with the Clerk of the Scales the fee for a losing mount in that race, and the Clerk of the Scales shall keep the accounts for the jockeys, pay over to them the money collected, unless he has notice to the contrary, and for his services shall receive two per cent, of the amount collected. The failure to deposit this fee for the jockey engaged for any horse shall declare it out of the race. Rule 157— Stricken out. Rule 160— In selling races the horse's engag ments are included if the horse is bought claimed. Rule 172 — Owners and trainers employing riders, grooms or attendants shall make their contracts in writing, properly signed and witnessed, whenever the time covered by the contract exceeds thirty days. Any person who shall entice or attempt to entice away from an employer, a rider, groom or attendant who is under contract, may be fined or ruled off. No contract shall be binding under these rules, the provisions of which give an employer any interest whatever in the earnings of a jockey, and the License Committee shall grant no license to jockeys bound by such contracts. Any employer or jockey misrepresenting the terms of any contract shall be ruled off. In the absence of written agreement the engagement of a jockey, groom or attendant ter minates with the last day of each month. If a jockey, groom or attendant be prevented from riding or service by suspension for fraudulent practices or other misconduct, any person who has retained or employ ed him may cancel the contract or retainer. In like cases, if any owner or trainer be prevented from running or training by suspension for fraudulent practices or other misconduct, the rider, groom or attendant may cancel the contract or retainer. Rule 1*— Steeplechases stricken out. It is a duplicate. The following new Rule was adopted: No person against whom there are outstanding forfeit orders or other arrears issued by members of the Congress shall receive a trainer's or jockey's license until the same are paid. The following new Rule was passed: Any person who shall enter or run a horse or allow a horse to be entered in a selling race while any claim is held against such horse, either as a bill of sale, chattel mortgage or lien of any nature, by anyone, without making the fact known at the time of entry shall be considered guilty of fraud and shall immediately be ruled off by the Judges, and any and all persons claiming title or ownership or any horse after such horse has run in the name of another person, having peaceable and undisturbed possession of same, shall be considered guilty of fraud and be ruied off by the operation of this rule. This rule to take effect immediately. Messrs. Tarlton, Fowler and Hopper were appointed committee to edit rules. The name of the Chicago Racing Association was changed on the records to the Chicago Jockey Club. L. D. Hall, James Arthur and J. R. Hand, who participated in racing at Woodstock, 111., run contrary to American Racing Rules, were reinstated. The horses, Barrier and Ramona, were refused reinstatement. The mare Maxine. formerly Fleur de Lis, whose name was changed East to conform to their registration rule, was permitted to run under the name of Mazine on Congress tracks. The following resolution was adopted : Inasmuch as the fund of the Turf Congress has accumulated beyond all possible future necessities, and as the fixed revenues are ample for annual expenses, Resolved, That the Congress appropriate to each of its members the sum of $1,000, or as much thereof as the different clubs may designate, to which a like amount shall be added by each club, to be known as the Turf Congress Sweepstakes of 1900, and to be run in one or more stakes as each club may provide. Of the sum appropriated one-half shall be paid to the trainers and jockeys of the three placed horses, as follows : Forty per cent., 20 per cent, and 10 per cent, to the trainers of the first, second and third horses respectively, and 15 per cent., 10 per cent, and 5 per cent, respectively to the jockeys riding them. And when any Association shall show to the satisfaction of the Secretary of the Congress that the above stake has been given and that its conditions have been complied with in full, he shall authorize the Treasurer of the Congress to pay over to each one complying the requisite amounts. The time for forfeiture of membership on account of not giving a meeting within the year was extended to September 1, 1900. The registration rule was amended so as to conform to the rule governing the Stud Book, except that portion of the Stud Book rule relating to the naming of foals. The old naming rule still stands. In what more official way could he give notice than through the Secretary of the Committee on Appeals? Hence the claim of the Harlem Jockey Club that Mr. Ezell could have no standing before the committee is untenable. So far as these papers show the decision of the club that the race was no contest is erroneous, and the purse should be paid to the proper parties."
