BOOKMAKER PLUNKETX OF BROOKLYN ASKS THAT HE BE JOINED AS A PLAINTIFF. Lieutenant-Governor Sanders Hakes Argument for Now Orleans Jockey Club Says Brown j Desires to Ruin the Track. I. New Orleans, La., January S. The arguments in the case of the application o II. 1). Brown for a receiver for the New Orleans Jockey Club and City I'ark Jockey Club were heard today by Judge Pur-lange iu the United States Circuit Court. The case was opened a few minutes after 11 o'clock with the reading of the original petition and two supplementary petitions which were filed in the case by Brown. These were read by Eugene D. Saunders, one of the attorneys for the petitioner. . T. A. 1 . I'lunkctt, a well known member of the "Mets," residiug iu Brooklyn, N. Y., and holder of twenty shares of New Orleans Jockey Club stock intervened and asked that he lie joined as a plaintiff. After the reading and filing of the petitions, Lieutenant-Governor Jared Y. Sanders, attorney for the defendant stockholders in the New Orleans Jockey Club made his argument. He said that the application of Brown was prompted by a desire to ruiu the track In order that the Western Jockey Club might gain control of the property and that Brown is working with the leaders in that organization iu the action which he is now taking. Another motive ascribed for Brown's action is a desire to "get even" for the alleged "turn-down" when he was not selected, as starter at the track this season. iu the petition Brown alleges that the action of the directors in leasing the property to the City i'ark club was illegal, inasmuch as no quorum was present. He also alleges that the property is not, lieluK properly cared lor; aa It Is Tiof paying the dividends which it should pay if managed in the proper manner. Lieutenant-Governor Sanders in his argument stated that Brown had made practically the same proposition to the directors of the New Orleans Jockey Club as had Mr. Barnes and that his offer had been refused, wjiile that made by Barnes had been accepted. The allegation of illegality in the leasing of the property was also denied. The attorney further stated that the action of Barnes and the nine meii who Joined him was for the purpose of protecting the property for themselves and the other stockholders. He stated that none of the officers of either club was paid any salary and that Barnes hold the propositon to all the stockholders from November 23 to the day on which the meeting opened, November 30. ' Big Crowd and Heavy Betting Goldmate Is Badly Injured Jockey Koerner Is Fined. New Orleans, La., January 8. Jackson Day brought great returns In a racing way at City I'ark today. The anniversary of the battle of New Orleans was celebrated by the holiday folks in a battle with the layers. The crowd wasfar lictter than was expected and the volume of business in the ring was probably better than on any other day of the meeting. Many of the books were simply flooded with the commissions and iu several races the money of the publie went begging. The Old Hickory Handicap was a great race. Alma Dufour, an added starter, picked up 122 pounds and wou, but she had to be the good mare that she is to do it. Despite the weight, the books did not hold her cheap. She was made the choice at even money and that price ruled throughout, while Attila was backed at 5 to 2 and. Harry Stephens and Coruscate came In for a lot of support. It was the best betting race of the day. Steeplechase jockey T. McHugh received word from George Saportas today to report for duly at Lake-wood, N. J. on February 1. The judges fined jockey Koerner $25 for striking jockey Springer across the back 'with his whip during the running of the second race. Goldmate was cut down iu his race Saturday and so badly injured that his chances of racing again iu the immediate future are slim. One of the colt's eyes was also injured. He may lose the sight of it. Troxler, who had the mount on Orly, claimed foul against Grenade, which beat liim out a length in the fifth race. The claim was not entertained by the officials. , Phil Finch Wins the Jackson Handicap: Ed Early Runs-Away-Jockey Shaw to Ride for Shields-Heavy Ring Operations PHIL FINCH WINS THE JACKSON HANDICAP. Ed Early Runs Away Jockey Shaw to Ride for Shields Heavy Ring Operations. New Orleans, La., January S. The feature race at Crescent ' Park today was the Jackson Handicap at line and one-half miles. It brought out the best long distance racers here. The prize went to Phil Finch. Although burdened with the heavy impost of 325 pounds, he put up a sparkling performance. He merely had to canter to defeat his opponents and stamped himself as' the best horse In training among the handicap division now stabled at the old track. Recently Captain Williams refused an olTer of $10,000 for this horse. The offer was made by Willie Shields. It is Captain Williams' intention to race him and lta'iii's Horn in the east next summer. With that end in view lie is said to have sent a big check to the forfeit clerk, settling his accumulated forfeit obligations. Speculation iu the ring today was of the heavy order, "Humming Bird" Tyler again monopolizing attention. He Is laying top prices and accepting wagers that most of the other layers refuse to handle. His winnings for the afternoon are said to have been close to $10,000. The attendance was" large. Jockey Shaw was at the track early this morning. He got iu from New York yesterday. He galloped a number of horses today preparatory to beginning riding. He will do most of the saddle work for Shields while here. Jockey W. Bobbins was suspended for four days hy the starter for disobedience at the post in the lirst race. Bets had to be declared off in the last race and twenty minutes allowed for a new book because Kd Early ran away iii his preliminary. He bolted through the gap after unseating his exercise boy and ran down the highway. Late reports were that he was still running and headed for Mobile. Preparing to Announce Stakes PREPARING TO ANNOUNCE STAKES. Memphis, Tenn., January 8. The New Memphis Jockey Club is preparing to announce reuewals of all its stakes, including the Montgomery Handicap and the Derby and Oaks for 1907, entries for these races iu 11)00 having closed last spring. From statements made by Jockey Club officials, iiowever. It is evident that meetings of much shorter duration will take place liere in the future. It is the consensus of opinion, even of the people who promoted the auti-raclng bill, that the decisions ot Judges Hart and Richardson that the act is unconstitutional will lie affirmed by the Supreme Court. Will Appiegate has arrived at San Francisco after a trip around the world. He will book at Oakland for the remainder of the season. Jockeys' Standing in 1905: Dave Nicol Does Most Consistent Riding and Heads the List JOCKEYS' STANDING IN 1905. DAVE NIC0L DOES MOST CONSISTENT RIDING AND HEADS THE LIST. Willio Knapp, Walter Miller and Herman Radtko Others Credited With Over 150 Winners Each 862 Boys Have Mounts. The number of jockeys having mounts In 'the 8,011 races decided at the principal tracks of the United States and Canada and covered by the charts In Daily Racing Form during the year 1005, was 862. Of these 112 rode ten or more winners each. 211 rode from one to nine winners each and 420 failed to finish first iu any race. The honors of the year, in the matter of winning mounts, go to Dave Nicol. The Chicago lwy, who began Ids career in" the saddle In the fall of 1903 and stood second to Eugene Hlldebrand iu the list of 1904, is at the top of the 1903 list with 221 winners, 20 per cent, of his 857 mounts. He lias been consistent through the two full years of his career, for In 1904 his- percentage was likewise.2G, he having that year 198 winners out of 757 mounts. While it is the public's vogue to follow almost blindly the boys who are riding frequent winners and it is the fashion of the dally press of the country to feature the winning , performances of these lads irrespective of the losers they ride, it is nevertheless from a basis of percentage that a jockey's true merit is to be determined. There arc other boys iu the list of winning jockeys who have a better percentage than Nicol, but none who rode through all of the twelve monthd j stands so high, and certainly there is no boy in the j list who can show 2(5 per cent. 6f winners riddcu for u. steady, or nearly steady, twenty-four months of saddle work. . . . dtto'o'mterly,rwTid came to "his' untimely death at Memphis on April 2 as the result of a falland kick from a horse which he was exercising during the morning hours at Montgomery Park, stood best for the year on a percentage basis with .31. Next conies the little boy Pcrretf, under contract to Hugh MeCarren, Jr. This lad never had a mount until after the opening of the meeting at City Park November 30 last, yet iu his first 27 days he rolled up a percentage of .30, riding 18 winners out of 5-1 mounts. Eddie Dominick, who abandoned thesaddle at the Brooklyn autumn meeting and went traipsing off to St. Louis on some unexplained mission, had u percentage of .2S and the ability to make It better had he stuck to his knitting. Cormack, the only other boy whose percentage was as good as .20, rode only at the Hot Springs meetings in this country last year. After the death of II. C. Schulz, hla contract employer, at Hot Springs in February last, Cormack signed a contract abroad and rode in France. He did well there. Heriqan Radtke, the Chicago boy wlio Is now under contract to J. O. Keene aud the most admired jockey at Sau Francisco, began riding at Union I'ark in St. Louis last spring. He was then under contract to J. F. Davis, who sold the papers to Mr. Keene for something like $5,000 when it le-came apparent that he would either 'Jbreak his neck or make good." He is fourth in the list in matter of winners 'ridden, but has a percentage of .25, just a point behind Nicol, the leader, and seven points better than "Big Bill' Knapp, second iu the list, and five points better than Walter Miller. These two last named were the sensation of the eastern season, the latter having columns of silly stuff written about lilin. After the elose of the. Ascot . I'ark meeting last winter it was shown in the columns of Daily Racing Form that Miller was a coming loy, hut the New York press overlooked the fact that he had early evidenced the making of a rider and set him on a high pedestal late In the fall, totally disregarding the figures of six months back. Jack Martin rode 10 per cent, of winners. Sewell, a coming rider, has 19 per cent. C. Morris, who has ridden winners in strings of 3, 4 and 5 per day, has a percentage of .17. B. McDaniel, auother Ascot Park sensation of last season, has 15 per cent. The others in the first fourteen the riders of 100 or more winners are Aubuchou, F. Q'Nelll, Treuliel, E. Morrison, Swain and Hlldebrand, who headed the list in 1904 witli 297 winners, and lost his license last September. The booby prize for the year goes to D. O'Connor. This boy is a graduate from "Father Bill" Daly's stable, but after his saddle work of 1905, the old man of the east will hardly go out of his way to admit the fact. O'Connor rode at seventeen meetings, had 147 mounts aud piloted one winner ; Veronese at 12 to i on the openiug day of the spring meeting at Belmont Park. Latonia Handicap Is a New One No Renewal of Derby and Oaks for 1907. Cincinnati. January 8. The Latonia Jockey Club's spring:-meetiugiwlll begin, utxjut May2tf;aiWutiraeii for thirty-one days. To cover this iierlod of racing Secretary Dillon, after consulting with the directors, will issue the stake blanks this week and the entries to the same will close February 15. 'The Latonia Derby was elosed last year and so were entries to the Oaks. The first named stake will be worth over $G,000 .and the last named $4,500. Renewals of these stakes for 1007 will not be made, as It is the intention to substitute for them more pretentious events, the American Derby being one. The following are the stakes which will close February 13, the first named being a new feature: Latonia Handicap, at a mile and a quarter, for three-year-olds and upward, with $3,000 added. $13 to accompany the nomination and $100 additional to start. Clipsetta Stakes, two-year-old fillies, five furlongs, $1,230 added. Harold Stakes, two-year-old colts and geldings, five furlongs, $1,230 added. Cincinnati Trophy, two-year-olds, five and one-half furlongs. $2,000 added and the Flelschinann cup worth $500. Brewers' Exchange Handicap, six furlongs, $1,250 added. Merchants' Stakes, selling, one mile, $1,230 added. Decoration Day Handicap, one aud one-sixteenth miles, $1,230 added. Kentucky Steeplechase, club house course, $1,000 added. Cincinnati Hotel Handicap, one aud one-eighth miles, $1,230 added. Montana Fair and Racing Circuit MONTANA FAIR AND RACING CIRCUIT. The Montana Fair and Bacing Circuit, which was organized at Helena Saturday, with It. D. Steele, of Bozeman, as president, and D. A. Galbreath, of Butte, as secretary-treasurer, will embrace the following cities of Montana: Butte, Helena, Anaconda. Great Falls. Lewiston, Billings, Livingston, Missoula, Kallspeil and Bozeman. At Butte there will be two weeks' racing. At the other points one week each. The season will open at Butte on July 30, and extend through to October 10, at Kallspeil. The total value of the purses to be offered will be $125,-000. The same racing officials are to act at all meetings, aud as there will be no conflict in dates great savings can be effected by stable owners through combining their shipments. 'The circuit includes the Montana State Fair at Helena, October 1. The board of directors are authorized to employ track officials for the association, and will act soon. It is thought the prolonged season and large purses will result in attracting splendid stables to the state. Four Stakes for Two-Year-olds FOUR STAKES FOR TWO-YEAR-OLDS. Entries to four stakes for two-year-olds to be decided at the Crescent City Jockey Club's track closed yesterday. The stakes were: The Premier, colls and geldiugs, one-half mile, $1,000 added, to be run February 3; The Martha Washington, fillies, one-half mile, $1,000 added, to be run February 22; the Carnival, four and one-half furlongs, $1,000 added, to be run February 28, and the Rosebud, live furlongs, $1,000 added, to be run Marcli 10. Stable Room is at a Premium STABLE ROOM IS AT A PREMIUM. Sau Francisco, Cal., January 8. Stable room Is at a premium at Oakland. Shipments from Ascot Park are becoming more numerous. There are two reasons for the exodus from the southern track. The schedule of dates for the local season embraces seven weeks more than that at Los Angeles and. the crusade against racing at Ascot Park seems to be gaining foreboding strength. The first ladies' day of the season at Crescent Park will be January 3. ( J. M. Murphy, the western bookmaker; is making an extended trip through Europe. Veteran Breeder of the Great Racehorse and Sire Explains Some of His Defeats, i Major B. G. Thomas, the veteran breeder, at his home in Lexington, Ky., talked Interestingly a few days ago of his once great horse Himyar, which has JuVtirctfrthe- '-aSPoirWypan, al the Ayondale Stud in Summer County, Tennessee. It is an odd fact that all the great horses of days gone by with which Major Thomas' name has been connected have been outlived by this Nestor of the , turf, now very close on to four score years of age. Domino, King Ban, Fellowcraft, Lelex, Mannie Gray, Queen Bau and Tonimie Atkins are all dead, and now Himyar has joined them in General Buford's horse heaven. As Major Thomas has survived all his contemporary turfmen and breeders of the days, soon after the Civil war, so he' has also outlived the great horses which have made his name famous in . turf history for all time to come. Said Major Thomas: "Himyar should have been retired with an unbeaten turf record. He never lost a race but that there was a good excuse for his being beaten. Take the Kentucky Derby, for instance, when Day Star beat him out. The starter left him nearly flat-footed at the post, and at one time lie was fully fifty yards behind the leading horse. With this disadvantage in the early part of the race, he closed up on Day Star in the stretch and gave him a battle royal for the money. Then there was the Elkhoni Stakes, in which Commie F. defeated him." said the Major. "That day the track was a sea of mud ou the inside, while there was a hard walking path on the outside of the course. Bob Swim got Commie F. on the hard outside, and the boy on Himyar held him close to the rail iu the deep going. At that he had only to pull to the outside on entering the stretch and walk home, but his jockey kept him in the mud and slusb, and, as a result, he was beaten. It is expected that the trouble over racing date for Oaklawn and Essex I'ark will lie adjusted some time this week. Dan Stuart, who is interested with John Condon Iu the ownership of Oaklawn is due here in a day or' two for a meeting with Sheriff Williams aud the owners of Essex Park. The Essex -Park people want an equal division of dates about twenty days at each track beginning from February 17. This is the date on which Oaklawn Park has declared, under the Western Jockey Club allotment, to open for thirty-one days or more. The citizens do not want a clash of dates here and it is expected that Sheriff Williams, who is supreme in these parts, will be asked to prevent such a thing. The sheriff, however, recently announced that he would not interfere In the racetrack troubles unless there sjiould be a violation of the state, county or city laws. Notwithstanding a moderate off-day card, the sport was excellent and witnessed by fully 0,000 spectators. Thirty-two layers were in line. Itadtke rode three favorites, Bosl XI Xi, Mafald and Hugh McGowan and a second choice Sir Brillar to Ignominious defeat, lieing unplaced except with Mafalda, which ran third. .Radtke and Robinson were fined for rough riding. The California Jockey Club gave lis annual banquet to the press yesterday at Oakland. It was a brilliant affair all around and the utmost good feeling prevailed. II. T. Grifllu left for Los Angeles today. His horses will remain and race at Oakland "to the end of the season. Cushing & Barbee, owners of Hans Wagner and other horses now at Ascot, have wired the local association for stall room. Garnet Ferguson attributes Bearcateher's defeat to a sore mouth. His announcement that Bearcatcher would not participate iu the proposed five furlong special, caused that race to be declared off by the club.
