PRICE 5 CENTS Cederstrome is Set Back: Carries Banker to the Outside and Miller's Claim of Foul is Allowed CEDERSTROME IS (SET BACK. CABBIES BANKEB TO THE OUTSIDE AND MILLER'S CLAIM OF FOUL IS ALLOWED. Coming on the Heels of Saturday's Incident, a Yell of Disapproval Is Raised Oxford Versus Protension a Possibility. Washington, D. C.November 2". In the closing race at Bennings today, a handicap at one mile and a quarter, Banker and Cederstrome came together again in a long stretch drive and Cederstrome got the decision by a close margin, only to be set back on Miller's claim of foul. The case was similar to their meeting in the Bennings Special last Saturday, except that today Cederstrome carried Banker to the outside, while in the previous race Banker had carried Cederstrome to the inner rail. Cederstrome led to the stretch, but soon after he straightened away for home Miller brought Banker tip with a rush and joined the leader a furlong out. Banker got on almost even terms with Cederstrome when the latter bore out and carried Banker to the outside fence by the time the judges' stand was reached. Saturday Daly's claim of foul against Banker was dismissed and today a crowd gathered around the stand at once in anticipation of a claim from Miller and anxious to see how the stewards would handle the. case. Miller made a claim as soon .as he had weighed out. The stewards allowed his claim and disqualified Cederstrome much to the chagrin of a majority of - the crowd, as Cederstrome was well supported while Banker went very badly in the betting. Many of those who saw the two races at once set up the long yell tbat Miller was being favored by the- stewards and that there was no more reason to disqualify Cederstrome than to have set Banker' hack "In "the Bennings Special. There has been a great deal of talk about the favoritism shown Miller by the officials and it is unfortunate that this should happen right at the end of the season to confirm the belief that Miller is favored. But the fact that Cederstrome was the aggressor last Saturday and that he clearly prevented Banker from winning today is overlooked. Long fjiots had an inning today, Society Bud, at fiO to 1; G. L. M., backed from 100 to 1 to 30 to 1, fttid Lnretta, at 12 to 1, taking- the long end of the purses in their respective races. Cabochon and Lady Karma were the winning favorites, while Banker was a hike warm second choice. Cabochon, Which was voted a "moral" for the second race and held at a short price, had to lie nursed carefully by Miller to reach the goal and cannot be much. A special race has been proposed for Saturday between Oxford at 130 pounds and Pretension at 120, the distance to be seven furlongs. Phil Cuinn, owner of Pretension is anxious that the race be arranged and says he will make a side bet of 1,000 on Ills horse. Nothing was decided upon today, but it Is not unlikely that the race will be arranged. Defeat of Gypsy King the Direct Cause Davis Is Suspended for Five Days. Oakland, Cal., Novemler 27. There exists a well founded local belief that no racehorse, however superlative his class, can escape at least one beating on California tracks. In the past a long procession of equine stars in their day have met their Waterloo here. This very fact kept the majority of the speculatively inclined public from betting on Gypsy King in the fourtli race at Oakland today. In the light of the recent victories of the Hildreth three-year-old, metropolitan layers would have held him at 1 to 10. Here he was at 7 to 10 and neglected by all save his owner, whose commission ran into five figures. Gypsy King could do no better than finish fourth in slow time. A charitable view of Knapp's ride is that lie was rattled. After his horse's failure Sam Hildreth stopped long enough on his way to the stewards' stand to inform the reporters that lie had released Knapp. "I will not ride him on my horses in future," he said, adding, "that boy would break the Bank of England." The stewards later on announced that a five day suspension had been meted out to It. Davis for cutting across In front at the start with Martinmas, causing the favorite to pull up. Afterward Knapp pulled him up a half dozen times of his own accord. Jockey Eugene Hildebrand's riding days are nearly over. Today he said that he would retire at the end of this season. "I intend to get together a stable of ten horses for a campaign on the Pacific Coast, principally at Seattle next summer," he explained. "I am getting too heavy to ride. It took a lot of hard work to reduce to 100 pounds today and it Is very weakening. I own two youngsters already. They are in Georgia just now." C. B. Durnell Is due at Oakland tonight with his big shipment of racers. "Canada Jack" Atkins' string arrived during the day. Morendo was bid up from $500 to $700 and retained. Bryan intend fo keep disqualified persons, off the Fair Grounds and announced today that jockey 1). Hall and bookmaker James Davis would be denied admission here in future. Both these turfmen were mixed up in the Hall-Ferrell-Adkins-Davls affair at Oakland in the winter of 1002 and were ruled off by the Pacific Jockey Club. Davis and Hall were reinstated by the American Turf Association, that is, In Davis' case the turf management ignored his presence. Hall, however, has been riding on American Turf Association tracks with the consent of the license committee. "There Is no desire to make an example of these parties," said Judge Bryan. "It S merely an intention to enforce a rule of all turf organizations to refuse privileges to persons ruled off by recognized authorities." Kiamesha is Fired and Blistered KIAMESHA IS FIRED AND BLISTERED. I Washington, D. C, November 27. -Kinmesha, the four-year-old brown daughter of Esher and He-llectlon has been fired and blistered. William Kar-rick, her trainer, attributed her somewhat unsatisfactory racing last spring and summer to a bad growth on her leg and to the fact that she was hurried unduly. An nmhltiouK campaign will 'not be planned for her next season. Mr. Knapp will not try to win any great handicaps with her. New York's Racing Interests Will Not Stand Idly By When Percy-Gray Law Is Attacked. "New York, November 27. The Jockey Club has kept faith with the public and with the lawmakers. It has respected a court order in the District of Columbia and, as usual, intends to act wholly within the requirements of the law. But racing men say that the Jockey Club, acting in good faith, will not stand idly by when renewed attempts are made to kill racing in this state. The enemies of racing say that they will have a forceful movement under way before the legislature convenes In January. They seek to combine the church element, with the Jerome crusade, with possible hacking from Governor Hughes, and they predict an easy victory. The legislators, however, know probably what the repeal of the Percy-Gray law means. While it could not close the racetracks, it would hamper the betting public to such a degree that the attendance .would be cut down materially. But even then a way would soon be devised by which betting would thrive again under new conditions. In fact, a prominent lawyer the other day outlined a new scheme to The Sun's turf writer on these lines: "Suppose the Percy-Gray law Is repealed; what will happen then? Why, there'll be a new shift in the cards. The tracks will remain open, the horses will run and the public bet. just the same but under an entirely new plan. Players will have to establish credit with layers away from the tracks. That is to say, a man before going to the races can hunt up Sol Liclitensteln at an advertised oflice In the city and place a certain amount, say .$100, with him. Sol takes his name, credits him in his book with the century and then both go to the track. The man picks out three different bets during the afternoon and makes them with Sol, who sees to it that his customer does not overplay himself in the event of losing. If a winner, the player meets Sol in town after the races, or rather the next day, and the account is settled in full.; Persons who know the bookmakers will not have to make such deposits, but the rank and file wlll. How linen, can"'anyVoTlyvgeta conviction of Sol for violating the law? He receives no cash from the customer at the track, makes only a few notes and that is all. But the law will not be repealed without a hot fight, young man; so it is not necessary to make new plans so early. There are "various ways to get around the problem, however, when the time comes, if it ever does." Illinois Racing and Betting ILLINOIS RACING AND BETTING. state's Attorney John "J- Healy is credltedy'with having said within two days past, "I am in favor of racetracks and have never opposed them. I do oppose gambling on the tracks, however, and will while I am state's attorney for Cook county. Gambling cannot be legalized in Illinois by the state legislature, Robert E. Burke or any one else. Racing is all right; gambling is all wrong." Tills amounts to stating that Illinois law makes betting illegal and that as a sworn officer he will do his duty in prosecuting offenders violating the statutes providing penalties for betting transactions. The statement that racing is all right is super-liuous. Racing is as legal as selling fnerchandise. But constructing and maintaining a racetrack is expensive. 'Purses and stakes to attract good horses call- for large sums of money. The officials and minor employees must he paid for their services and that calls for more money. All around conducting racing is a costly business. It cannot be carried on without reimbursing revenue. As the sport has been conducted that revenue is derived from fees for admission, from concessions for selling refreshments, from the sale of programs and, directly or indirectly, from betting privileges. In the east little direct revenue is derived from betting. But the great crowds that throng the New York tracks go there mainly to bet and at $3 for admission, pay the bulk of the receipts of the racing organizations in gate money. Thus in an indirect way it is betting that pays the bills, for. few of the people who go to view the decision of a Suburban or a Futurity would be in attendance If they did- not know perfectly well that they would be able to back the horse of their fancy. In the west the bookmakers as a rule pay $100 per diem for the privilege of conducting business and this constitutes a direct revenue from betting that goes far toward meeting the expenses of the sport. Again as In the east, the people who attend go to the track to bet, It may be on only one horse or It may be on several, but at any rate as well as desiring to see the beautiful creatures run they fully expect and desire to bet they can pick a winner or two. Also, as in the east, the majority would not go to the track at all If they did not expect to combine speculation with observation. The obvious and truthful deduction Is that high-class racing cannot he maintained without the support of the revenue derived in one fashion or other from betting. Carter II. Harrison demonstrated this to perfection when he wrecked Washington Park. There is no getting away from this. And Mr, Healy is probably right when he says 'gambling cannot be legalized In Illinois by the state legislature." The Supreme Court decision in the Swigert case points that way strongly. There have been decisions In other states that wagering on a horse race is not gauibllnr. But that Is not very pertinent In Illinois In the face of the decision referred to. The bookmakers had an inning today and recouped a goodly portion of their losses. Outsiders scored in four of the six races, Missouri La'd and Juggler being the successful short priced horses. The card was an ordinary one, but the sport resulting, was keen and finishes in four of the races were close and exciting. The eastern contingent was active to the extent of four winners. Of these Archie Zimmer, trainer for T. D. Sullivan, took the first two with Dry Dollar at 20 to 1 and Cannon Ball, liberally supported at G to 1. Jack Sheehan parleyed $40 on the pair and cleared nearly $4,000 by their victories. Pat Dnnne furnished two of the beaten favorites In Bonart and Airship. Both were ridden by Nlcol. His handling of these horses was listless and called forth unfavorable comment. He was not all at fault on, Bonart, however, as Austin, on Idalla, Interfered sharply with his mount. Austin was cautioned by. Judge Bryan. Fred Cook gave away the stand he had and bet heavily from the ground today. He averaged 3 to 2 for a $1,000 commission on Missouri Lad and quit the day with a handsome profit. J. C. Milam received word from Memphis this afternoon that his colt Add, Jr., by King of Coins Century, had died from lung fever. Rubaiyat, in the E. S. Gardner string, died here last night o lung fever. Jockey Aubuchon has severed his connection with tho Capo stable and -will lu the" fnture"ride as a free lance. Jockey Dale was suspended for three days by the starter for misbehavior at the post. Jockey J. Foley was suspended for three days by the judges for foul riding. Jockey Swain will do the riding for W. A. Klrwan during the remainder of. the whiter. Steeplechase jockey Tom McHugh arrived here today from Louisville, where he has been confined in the hospital as the result of an old injury, necessitating two operations. The injury was sustained by a fall on Galba at the last Hawthorne meeting. The horse broke his neck at the time. C. It. Ellison's horses arrived this morning from. Memphis and are stabled at the Fair grounds. J. H. Baker arrived at City Park with nine horses that he shipped here font Lexington, Ky. S. S. Tracey. got In from Bennings with his stable. The Grand Consolation Winner THE GRAND CONSOLATION WINNER. There is considerable Interest attaching to the future career of Monfort since he won the Grand Consolation. Each prior winner of the most valuable Bennings event proved a racer of merit in subsequent years. It remains to be seen if Monfort is to follow In their footsteps next year. Lord of the Vale won the first Grand Consolation. That he was a high-class racehorse his fast Saratoga Handicap and other victories In the best of company attested. Orthodox was the second winner and was a crack three-year-old, his mile in 1:3S at Aqueduct, leing now the record at that track. Next in succession was Dandelion and all students of turf lore know that this fast and game son of Hamburg was in the front flight of the handicap cracks of 1906. Last year the fleet filly. Flip Flap, was the winner and tills year she classed with the best of her sex and age. All in all Monfort will have to be a smart three-year-old if he is to be accredited as classing with the previous winners of the Grand Consolation. Monfort, a chestnut colt, by Ornament Eleanor, began his racing career in a purse at four and one-half furlongs at Aqueduct, April 26, and at 40 to 1 In the betting, ran third to Mexican Silver and Black Mate in :55J. His first success was at Belmont Park, May 30, when he won a purse at four and one-half furlongs by six lengths In :52 from Jaunty, Greeno and fifteen other youngsters, setting a new track record. June 4, at the same track, he won another purse at the same distance by six lengths from Garters, Halton and four more in :52g. At Slieepshead Bay, June 27, he won at five and one-half furlongs In 1:07 from Frank Lord, Black Mate and twelve more. He won by a length. July 10, at the same track and same distance, he again won and singularly enough Frank Lord was again second and Black Mate third. He beat Frank Lord three-quarters of a length. Thirteen ran unplaced and the time was l:07i. Then he ran several times unsuccessfully, until at Brighton Beach, July 23, he finished second to Tourenne in the Undergraduate Stakes and was awarded the race when Tourenne was disqualified for fouling. Tourenne had only won by a head, and the good youngster J. C. Core was third. It was Monfort' s first success in a stake race. After that he did not win again until he began his successful career at Bennings, but he nearly always finished in the first three. His last race prior to being taken to Washington was in a dash of six and one-half furlongs at Aqueduct for which he was heavily backed by his owner and friends, but ran third to Main Chance and Acrobat. This had the effect of abating confidence In him and he started for thp Grand Consolation an S to 1 outsider, but won In gallant fashion by three lengths better than Orphan Lad, -with the 0 to 0 favorite, Tourenne, third. In view of the fact that the track was muddy the time, 1:282, compares favorably with any previous record for the race. Since then the colt lias won two purses, but these races have been run so recently as to require no comment. Except in the Undergraduate Monfort has been ridden by V. Miller in all of his victories. He is a very fast colt and there Is no reason why he may not prove a stayer. His record Is now as follows: Starts. 1st. 2d. 3d. Unp. Amt. 21 - S 5 3 a $11,925 Persimmon Leads Sires in England PERSIMMON LEADS SIRES IN ENGLAND. The English flat racing season closed Saturday last with the meeting at Castle Irwell, and -toward the end there was an exceedingly close contest between the winning sires. According to the latest sporting exchanges Persimmon jumped into the lead rather suddenly, owing to the racing of Keystone II. For several months Ladas, Carbine and Gallinule were close together, and it was the opinion that one of the trio would finish at the top. Only the sum of about $500 separates Persimmon and Ladas, but the latest reports were that little as the money appeared Ladas conld hardly make it up. Persimmon's total is $99,0S5. Lord Derby, who leads the winning owners' list, has Increased his total, it being now $155,533. Most of this fine sum has been contributed by his grand filly Keystone II., which is at the top of the string; of winning horses with $64,150. Major Eustace Loder Is in second place with a total of $SS,745, and his percentage is higher than that of Lord Derby, for his figures were made by twenty horses In forty-three wins, while Major Loder had only seven horses and eleven wins. As Irish and French meetings are not tallied on the English list, Major Loder loses the $50,000 won by Spearmint in the Paris Grand Prix, which with about $5,000 won in Ireland put his grand total close on $144,000. Colonel Hall Walker is in third place, with $71,675, the result of twenty-four races won by seven horses. "Earthquake Ticket" is Cashed "EARTHQUAKE TICKET" IS CASHED. All of the winning tickets written at Oakland, April 17, the day preceding the San. Francisco earthquake have not been cashed. A man showed up with one last Saturday. It wa3 written in the Berkeley Club, which was backed at the time by Edwin Gaylord of Denver. He hunted up the owner of Rubric and got his money. It is said that there are scores of tickets still out and it is expected that they will be turning up at intervals throughout the season. This story of how the boy came to him was told by Mr. Respess to the Cincinnati Enquirer recently: "My horses were over at the old iS'ewport racetrack and one evening, when I was bound for the kitchen, I came across a little lad sitting on the 'ground, crying as if his heart would break, I asked what was the matter and between his sobs I learned that he had been abandoned by some man who .had a stable of horses and had to sell them and skip to avoid the sheriff. "He told me his name was Tommy Knight and that his parents were living at Lexington, Ky., and I. after a good deal of persuasion, got him to accompany nie to the eating place. Though he was repeatedly urged to sit at the table and eat with us, ho wouldn't budge, and when I finally Insiste.l that he niusf eat, he said: 'Boss, I don't belong at the table with yousc; I'm a colored boy.' "That'vaU a surprise to me, as I thought that he was white, and so he waited until we were through and then he sat down and ate. I sort of took a fancy to him, and when I went to Lexington to the sales I 'ooked up his mother and took a contract on his services. "Whu,t a rider he turned out to be is well known. If I went out and took him along and happened to fall into a card game or any sort of gambling, when I left there would be Tommy on the outside, curled up asleep waiting for me. He has been a good boy to his folks, and there will always be a place for hlni with me. He has saved a good deal of money and will never want." Fined for "Cheating the Handicapper" FINED FOR "CHEATING THE HANDICAPPER." The Austrian representative of the London Sportsman tells of an occurrence at Vienna that is apt to impress Americans who are opposed to having finishes intentionally drawn fine, though there are few jockeys of this day and time who are really capable of what in the days of Isaac Murphy, "Snapper" Garrison and Willie Martin we were want to call artistic. "I went over to Vienna last Sunday to see the Austria Prels," says the Austrian correspondent, "and it so fell out that a certain jockey won a race hands down by a neck. The stewards of the Austrian Jockey Club called the jockey before them. 'You won by a neck, couldn't you have won any further?' they asked. "The jockey was delighted that he had found himself on such a good horse, and replied in a practical tone: 'I had always got them beat sir; I could have won by as far as I liked.' "The retort of the stewards to this astonished him, as, if delivered in England, it would astonish an English jockey. 'Then, that shows you were trying to cheat the handicapper, and you are fined 10.' I have no sort of wish to criticise the action of the Austrian Jockey Club stewards, but the jockey in question had no notion that in doing what he did he had done anything wrong. "A jockey in Austria was fined 5 by the stewards because he was not out one morning before breakfast to ride exercise, and on the whole the jockeys there appear to be treated somewhat drastically." The second day of the Fasig-Tipton Company's sale opened with the consignemt of the estate of the late Captain S. S. Brown and with it came confirmation of the statements recently made by Daily Racing Form to the effect that W. Harry Brown would buy the pick of the offerings and continue the stud which his brother had established at Senorita Farm. Three stallions and twenty-two broodmares from this noted farm passed through the sales ring and all save four The Friar, Clementina, Monadour and Rheta were knocked down to Mr. Brown. The stallions, Broom-.stiek and Garry Hermann and nineteen mares, eleven of them with weanlings, were sent back to the farm this evening. Max Samnelson will continue as manager of the farm. He will leave about December 1, for a fortnight's hunting in Alabama and upon his return will settle down to the business of breeding, with the hope that he can produce such another crop of yearlings as were sold at Sheeps-head Bay this year. Mr. Brown, as will be seen from the summary of the sale, was forced to pay handsomely for the royally bred stud matrons. Harry Payne Whitney, Andrew Miller and Frank C. Bishop were the contending bidders. It was the latter who forced Mr. Brown to go to $14,G00 for the stallion Garry Hermann. The only mare in the lot for which Mr. Whitney succeeded in outbidding Mr. Brown was Monadour, a good racer in her time and dam of Lampoon. Following the consignment from Senorita Stud came that from Oakwood Stud, offered by the estate of the late C. F. McMeekin, who was killed in the wreck at Salisbury, England, July 1. Sallie of Navarre, the dam of Salvldei-e, was he mare most eagerly sought in this lot. She went to Harry Payne Whitney for $10,000. The stallion Wools-thorpe, which was the joint property of Milton Young and Mr. McMeekin, went to Mr. Young for $500. Followiug the McMeekin consignment came that of the estate of John E. McDonald, who met death with Mr. McMeekin. The stallion Rensselaer, for which Mr. McDonald had a particular fancy, was purchased by Harry Payne Whitney for $100. The total number sold was 110.
