January 4. — The racing public la beginning to show much concern over the continued absence of presiding judge E. C Hopper from the stewards' stand at Oakland. Mr. Hopper has been ill for three days. The unusual spectacle of a mob of howling spectators crowding around the judges' pagoda after the placing of numbers in the fifth race today emphasized the pressing need of his services. Exaggerated rumors of his illness have been current. Starter Holtman was again hissed after the start of tiie fourth race, won by Andrew Mack. This bane was an oddn-en favorite and was nearly left at the post. The fault lay entirely to the horse's sleepy jockey. Miller's tilling again was the feature of the day's racing. The champion jockey scored his usual two winning mounts. Neptunus was a receding; favorite ami the regular Duruell plunge was conspicuous by its absence. SOME THINGS REFORMERS FORGET. •'In making a crusade against racing in this s state." said a prominent owner of race horses to the New York Sun. "the reformers possihly forget a few-things. In the first place, racing has the support of thousands of eitizens id all classes. The sport is a hnsiness conducted on honorahle lines and affords as much of a chance to speculate as Wall street. In the second place, the agricultural societies up the state are cutting up each year atKMit $300,00(», accr i-iug from the stale racing lax. which has made the various county fairs most successful. In the third place. Ihe breeding bureau of the Jockey Clim, in placing about thirty NJ ally-bred stallions at the disposal of up-state breeders, has strengthened its position materially. Furthermore, the racetrack owners can show proof that in no way do they recognize or receive a peuny in tribute from the betting element. Racing has grown into an immense industry. Thousands of persons have lieen enabled to gain a livelihood, while powerful interests have been indirectly benefited. Just why reformers can come to Albany from other states with a plan to interfere with racing . when it is on the top wave of prosperity and has the support af the public at large is a puzzle. Persons who do not believe in racing are not compelled 1 lo visit the tracks, which are splendidly conducted I ami situated far away from the business section of the city, When the tight begins at Albany you will I find that "the Jockey Club will stand on its merits. . The recent action of the house of lords and house of commons in piloting a measure through Ihe RngUah parliament prohibiting the making of so-called handbooks on Bngllxb borne racing has en- gasnd attention of legislators in Tennessee, some ol whom l K»k with favor on the sport as it has been conducted in Tennessee for more than half a century past. "From reports received from middle Tennessee there is every indication that, instead of an attack being made an Baal selling and horse racing itself during the hours of the comiug legislature, there will be an effort to show that all the damage done is by the knndheaka and down town poolrooms in the various cities where horse racing is fostered." says the Memphis Ccmmercial Appeal. "Fnder the present law of Tennessee it is asserted that any person can legally conduct a poolnx.m or handbook ill any town while there is racing within the state. This |HTinits the ordinary followers of racing to congregate in down town p laces and gamble to their heart's content. "A member of the so-called reform element that fought the racetrack people and Interests has been recently converted, it is said, and will endeavor to siiow in the legislature that so long as any of the looked ou evils of lictting on horse racing are confined to the racetrack that little damage will be done except to tln sc who dabble in the game. A measure will be looked for. it is said, to engage the attention of the assembly which may be voided* something like the measure that lias rei-ently passed both houses of parliament in Fngland and which roads like this: " "Any person freiiuenting or loitering in streets or public pi.ices on U-lialf of either himself or any other person, for the purpose of bookmaking or betthnjC or wagering, or agreeing to l et or wager, or paying, or receiving, or settling bets, shall on tirst conviction lie liable to a tine of £10 ($50), and for second conviction £29 ($100). In case a third or subsequent offense or in ease of a betting transaction with a person under the age of sixteen years the defendant is liable to tine and Imprisonment upon conviction on indictment.' "Some members of tiie reform element are on record as stating that it is down town conditions during racing time in Memphis that aggravate non-patrons of racing. The tout, the colored hustlers and ragged regiment in general, say those who have watched the conditions, congregate on the sidewalk, blocking traffic to such an extent that ladies are forced to take the streets in order to pass. Ky., January -I. -Mayor Ihrhfl anil the city of I.atonia filed answers in the Circuit Court yesterday to the injunction petition of the La ton la Agricultural Association, which sought to prevent the city of Latonia from tearing down a portion of the fence around the race course. The City Council of I.atonia recently passed an ordinance ordering the racing associations to remove the fence from certain streets which, it was alleged, had Iks-h dedicated. A few days ago the association made application in the Circuit Court for an injunction against Mayor Dalle and the city of I.atonia, and a restraining order was issued anil the motion for an injunction set for I hearing tomorrow. In his answer Mayor Earle admitled that it was his intention to tear down the fence unless restrained by the Courts, and accompanying the answer of the city of I.atonia were thirty-five deeds to lots eaahtneed in the rue course tract conveying the propertj to the agricultural assixiation. which were filed as exhibits. Each of these deeds acta out that the property transferred abuts on certain streets, giving their names. A ropy of the Jones subdivision, oue third of which is within the mcetwek toeloaare, also was ■led as an exhibit. The portion of the Jones subdivision outside the inclosure is built up with houses, and most of the streets have been improved. This eapy shows that streets were laid out and extended into the race course. Mayor Earle says that he intends to fight this legal battle to the end, and that he will not cease in his efforts to fon-e the racetrack off dedicated •streets until he wins or the highest court in the state enjoins him from doing so. He is by Mincemeat, out of Lady Whimsical, a mare Which was brought to this country in UIOO and returned to England in 1003 with a foal by Russell, which was named Fantastica. His dam is I^eetta. half sister to Hazlet and Emma Mac. Hazlet was one of the good two-year-olds in 1888. He won about 818,088. Fred Burlew paid 8MB for Blue Lee last July at the sale of the Sunny Stepe yearlings. Love of Gold, which is coupled with Firestone as the Hildreth entry at Oakland today, was bred at Rancho del l'aso and brought $.V»0 as a yearling last June. Her dam. Love Chase, is a young m.ira and was never meed. Love Chase is a full sister to Cylindrical, a winner in England. Lone Fisherman, a winner in this country, is a half brother to Love Chase.
