A bay filly by St. Maxim — Sweet Anna Page, by The Bard, is rather small, but is a taking type filly, and. being a good doer, will probably thrive and spread out during the winter months. Hughes is Hostile to Racing: Recommends Repeal of Percy-Gray Law to New York Legislature GOV. HUGHES IS HOSTILE TO RACING. Recommends Repeal of Percy-Gray Law to New York Legislature. New York, January 1. — Governor Hughes' message to the legislature today altacks racing and asks the legislature lo take action for the repeal of the Percy -Gray law. He quotes Article 1. Section 9 of the constitution as amended in 1MI5, j roviding against bookmaklng, seals and lotteries and says that the legislature passed a law the same year permitting liookniaking it authorized tracks where no record of bets was kept. He also quotes a decision of Judge Cullen, technically upholding the law ami then goes on as follows: "A different question, however, is presented to the legislature in the exercise of its discretion ami that is the question of legislative policy and of a substantial, ami not a mere technical compliance with the explicit constitutional provision. The constitution makes it the duty of the legislature to enaet appropriate laws to prevent |mmi1 selling. Iiookiiir.kiiig and other kinds of gambling. Ex-lerieinc lias shown that the laws enacted have not iccomplislied the purpose which the constitution defines. ''The evils and demoralizing influences, and. It may be added, the economic waste at which the coiistiintiou aimed, exists under the law and. iu fact, are stimulated and increased through its provisions. The discrimination in penalties now existing rests on no distinction that is justified to the popular mind. Public sentiment is against such arbitrary distinctions, with the result that the laws against gambling outside of raee tracks have been «i"ti. il .• .',d thy administration of the law has he« n brought into contempt. "The constitution makes no exception of race tracks. I recommend that the legislature carry out the clear direction of the people without discrimination. In connection with the repeal of the existing exception, I recommend that the offences described in section 351 of the penal code should be punished by imprisonment, and that the alternative of fines should be abolished. "The racing law provides for a tax of five per cent upon the gross receipts at trotting and running race meetings, which, under the agricultural law. becomes part of a fund for distribution each year among various agricultural societies in pre-seribed proportions. In order that there may be no diminution of the support upon which these societies largely rely, appropriations may be made for their benefit to the extent necessary to secure to them amounts sul stantially equivalent to the sums they heretofore have received. It is better that they should be supported dicectly than that the state should derive a revenue for this purpose through an indefensible partiality in the enforcement of the fundamental law." This probably will bring np again the bill that was in the house last season, but did not get out. Some turfmen of influence regard this action of the governor as a serious matter and well calculated to break up the sport. Thoy regret that the governor has placed himself on the side of the "Aliens." the "Nigger Mikes" arid riffraff poolroom people, who are jubilant over his message, and with li4s en I ire disregard of the breeding interests and property values represented by the thoroughbred horse throughout the entire country. Other horsemen pooh-pooh the proposition and refuse to consider it as at all dangerous to the sport. One said: "It is not likely that W. K. Vanderbilt would be spending $130,000 this winter improving and beautifying Sheepshead Bay unless he felt pretty sure of where he stood." and there you are. Orby Out of All His Races ORBY OUT OF ALL HIS RACES. London. January 1.— Richard Croker's Onne — Rhoda B. four-year old, Orby, the Epsom Derby winner of 1907, has been struck out of all engagements in England. He did not have many and no good reason is given for the declarations out of those stakes in which he was entered. That the son of Orme is practically sound fofracing purposes. and there would be no doubt of his standing another preparation if only he were in England, but no Irishman claims that so far as training goes a horse lias aeytliing like the same chance in Ireland as in England, and instead of thinking that Wool Winder was unlucky to be beaten for the Derby, it is wondering what manner of horse Orby must be who could go over from Ireland to win it. Certainly none has seen anything like the best of him, though it may be that a mile and a quarter is his liest distance. Mr. Croker will make a colossal blunder if he retires this colt to the stud at four years old, for a Derby victory is not a sufficient demonstration of his real merit, and as he can be "trained next year, if on suitable ground, there seems to be every reason why he should be given a chance to show what he can do when at his best. A match between Orby and Wind Winder is even being proposed, without much chance, however, of one being mad". $300 a Year for a Race Track $300 A YEAR FOR A RACE TRACK. The modest way . Lee Rose Captures the Race for Two-Year-Olds — Gemn. ell's Impressive Performance — Miller Rides Poorly. Oakland. Cal., January 1.— Again did a horse triumph in a big stake at Oakland which had received his preparation at Arcadia, and had been sent hero from the south especially to parti-jpate in its running. This time It was Aiimo from R. F. Carman's racing establishment, now wintering in the south. The skillfully manipulated Spnvkels-bred horse had been defeated so regularly of late by inferior horses, with the one exception of his last race, in which be beat only moderate opponents, that the local handieapper had been beguiled into tossing the gigantic four year old into the Christmas Handicap with the feather impost of '.Oil pounds. The rest was easy. Carman sent a big commission and his commissioners never stopped bet-ting. The knowledge was general tiiat the owner contemplated a huge plunge and the ring very promptly installed Arlmo a favorite at 2 to 1 in a field of ten. including the best brand of handicap performers in local training. In the actual race the result was never in doubt. Burns urged his mount into the '.' - ' W!tlH."lt ili-'-iy ~. | .,• .... ;.• .,. . ..• _.. i heart-breaking pace that at the end of six furlongs those liehind him were hopelessly leg weary. This left the favorite to come home alone. Trainer Blute had made no pretense of keeping his horse under cover, but told everybody within reach and under circumstances of the widest publicity. Arimo's success probably brought more 'financial benefit to the race going public than any previous winning coup of this winter. The condensed history of the New Year Handicap is as follows: Year. Williams was represented by a grand looking chestnut colt by Fatherless— Aurie. The biggest upset of the afternoon came with his defeat. A more precocious opponent, in Lee Rose, took his measure and the race by a half dozen lengths, but this running will surely be reversed when they mcr again. Miller's efforts were beneath the level of a stable lad in skill. The public hacked Blameless heavily and hissed the champion jockey for his in ferior saddle work. In Geminoll. winner of the closing rice, was revealed a nearly high-class four year old. The time, 1:28* for the difficult seven furlongs journey, was extraordinarily fast. The weather was perfect, the only drawback being the very muddy track. Eighteen thousand was the estimated attendance and forty-one books attended to the wants of the speculatively inclined. Tanforan Track Reopened TANFORAN TRACK REOPENED. San Francisco. January 1.— The officials of the Pacific Coast Jockey Club have met the well founded complaints about the difficulty of properly fitting horses during the had weather, and have put the Tanforan track in first-class shape for the accomodation of horsemen who may wish to take advantage of it in getting their horses ready for their engagements. Training is possible at all times at Tanforan, regardless of weather conditions, as the sandy main track never becomes bad. and in addition there is a sod training track. There Is plenty of good stabling in and around the Tanforan track and owners are much pleased with the arrangement. Hall Walker got a heavy fall while riding with the Cheshire hounds last week, and was severely hurt, though he will recover. Colonel Walker created a record last racing season by winning the Gimcrack Stakes at York for the third year in succession, the successful animals being (oienia in 1905, Polar Star in 1906, and Royal Realm in 1907. He headed the list of winning owners both in 1907, with a total of $S9,552.50. and in 1905. with the huge sum of $128,435.
