Conville annexed a purse for the Cella Stable when he won the fourth on the card in a sharp drive from Ganihrinus. His victory was a tiukey one. for Sumter, who rode Ganihrinus, made the mistake of guiding bis mount extremely wide, and thereby lost enough ground to have given him a winning margin m\ the end. Melange, which has been coming with a good burst of speed in receut races at short distances, found conditions exactly to her liking and took tlic last race in a big romp. Gordon says that in drafting his pnpMki law he ]i;iv been guided by the anti-lottery laws enacted some y.-ars ago. and if his bill is passed no tele graph company could handle messages conveying tips, nor the |H stal authorites allow the transmission of any literature designed to promote lK-tling on lt. r.-e races. He believes that the racing of the thoroughbreds can be stopped in this way. And it might be remarked that his bill is now rei-eivinu about all the notice it will ever receive. Mayor Earle Would Overcome Recent Court Decision — Arnett Opposes Continuous Racing. Frankfort. Ky.. January 17. — Two bills are now before the Kentucky lesislature dealing with the authority and powers of mayors and the right of cities of certain class to annex contiguous territory. Louisville and l.atonia are seeking the amendments, l.atonia wants to annex that part of the l.atonia race track which does not lie within the city limits, while Louisville wants to annex the site of the present Douglas Park race track. Another bill, which is backed by tiie mayors of fourth-class cities, enlarges the powers of mayor.-lo such an exteur thai they may suspend police officers for the non-pet foiinance of their duties. This hill is a pet of Mayor J. T. Karle of Latonia, president of the Kentucky Law and Order League. Karle drew it up with a view of applying its terms at Latonia. where t lie town council, favoring Horace track, has cut off his riajht to direct the police department and prohibit lietting and the sale of intoxicants. In a bill introduced by Representative Louis Ar nett. of Covington, limiting racing in this state to forty days on any track, the first step is made to put an end to continuous racing. A fine of not less than $1,000 nor more than $5,000 for each day's racing after the time, prescribed by law. Successful Trainer Abandons Racing ' " SUCCESSFUL TRAINER ABANDONS RACING. Lexington. Ky.. January 17.--"I am done with racing for keeps as an owner or trainer.'' said S-ott Hudson to a group of friends in The lobby of the Phoenix Hotel a uiuht or two ago iln I son came into the turf world some fifteen or eighteen years ago as the owner and driver of a couple of mediocre trotters. He had ploughed up the best field -in his father's farm in Garrard County, that he might construct a half-mile track, and there he trained the horses with which he made his debut at the Richmond fair. It was an auspicious debut, for he won the first time ut. From that beginning he advanced until his winnigs on the Orand Circuit some years aggregated $Sn.(ioO to $]tK).00O. About four years ago ' his eyes got bad and he quit the trotters for the thoroughbreds with the reputation of being one of the best drivers and tsainers who ever sat in a sulky. Two years as an owner and trainer of thoroughbreds sufficed. He sold out and opened up a big livery and boarding stable in Atlanta. On., and 1 leased a 'section of the stockyards in that city sufficient to quarter 300 mules at a time. That is his game now. "And," he says, "let me tell you it lieats the other shoes to plates. Its 1 surer money, boys. and. though it may not come so fas" at times, the getting of it is not so strenuous. It would take a mighty big chunk of money, and that cash in advance, to induce me to train 1 another string of horses. "W:iy. when the days were bad and the track ; muddy, I used to do more stall-walking than any racer that ever looked through a bridle. Inless 1 you have been through the game as I have, you 1 have i'o idea of the worry and solicitation that attends the handling of fifteen or twenty or more horses during the campaign. I never was one of the s«rt who could train horses from a hotel. I wanted to know them like the teacher knows his book and the only way I could do that was to get in the sulky and ride the miles behind them myself. ,,r if it was a string of thoroughbreds I had I wauled to he there when they went out and came in wauled to see every step they took and everything they ate. It is the only way. but it does not pay." Penalties in the New York Bills PENALTIES IN THE NEW YORK BILLS. Alb.iny. N. Y.. January 17. — Assemblyman Hart of 1 tica. has introduced his substitute bill for his nnti-ra-c track bitting bill, similar to the original measure except that the provision making the minimum penalty six months' imprisonment is eliminated. The maximum iienalty remains at not more than one year's imprisonment. He also introduced the substitute for his penal code amendment bill, removing the provision that six months shall be the minimum punishment for race track lietting. As it now stands, the measure provides a penalty of imprisonment in the county jail or penitentiary for not more than one year. Sinator Agnew has introduced the Paine bill. Governor Hughes today declared informally his approval of the combination of the Agnew Hart anti-race track betting bills as amended so as to i provide a penalty of imprisonment only. "In a great propivsition like this." said the governor, "a line would be meaningless, as I indicated in my annual message to the legislature." Plenty of Time to Ask for License PLENTY OF TIME TO ASK FOR LICENSE. • New York. January 17. — The license committee of the Jockey Club will not hold a meeting until I the latter part of next ruonih, for the reason that ' a large number of the jockeys and trainers before that time have not made tip their minds whether to 1 choose the eastern tracks or remain in the middle west. The meeting at the time proposed will give ample time for them to determine whether to make ■ application or not and early enough to issue licenses 1 to ride or train at the Penning meeting, which is i the first under the jurisdiction of the Jockey Club. This will have a tendency to bring out the best horses here and preclude in a me.t sure the possibility of lop-sided races. The Shields gelding. Diamond, after several unsuccessful attempts made good today, being heavily backed by the eastern contingent. As usual he acted badly at the post, but got away in his stride and dashed into an early and big lead, winning easily. The program wa-s featureless and the racing only ordinary. The weather was sunimerlike and the track fast. R. F. Carman withdrew all bis horses carded to start today and his colors will probably not be seen in a race here for several days, owing to R. F. Carman. Jr.. undergoing an operation for appendicitis last night. Madeline Musgrave won the race for two-year-olds after making a, fast sprint in the stretch to overtake the pacemaking Rell of Brass. Silk Hose, the favorite, rait disappointingly. Golden Rule, off flying, proceeded to set a fast pace and never left the result of the third race in doubt in any part of its running. Grenore ran well for the first half and then retired. Bellmence won what might be called the feature of the card, in that the fourth race was at one mile and an eighth, while the other five races were at six furlongs, or less. jn distance. Avontellus closed a nig gap and. took second place in the last stride of a gt:mo finish. Giovanni Baler io essayed to set a fast pace for a mile, but found the distance too far. Afraid of Santa Anita Candidates ' 1 1 1 ; 1 1 AFRAID OF SANTA ANITA CANDIDATES. Oakland. Cal., January 17. — Local horsemen are wondering if the contingent now racing at Santa Anita Park, whence have come in quick succession four horses winning as many of the stakes at the local track, will continue that order of things and also take the Burns Handicap. I* .Z. De Ar-man shipped Early Tide here to win the Pacific-1'nion Handicap, the Keene Pros, brought Clamor from Los Angeles and won the Christinas Handicap and R. F. Carman took the New Year and Follans-bee Handicaps with Arimo and Magazine respec- tively. S. C. Hildreth and R. F. Carman are the principal nominators to the $10,000 race and both of them are now at the southern track. Their horses eligible to start are probably the best of the entry list and. coupled with the fact that the horses are now tit and ready owing to the advantage of having a fast track for training, is an additional reason why the owners who have remained at Oakland fear that a Santa Anita horse will win the big race. That ten or twelve horses will be shipped here from Los Angeles to run for the Burns is a conservative es- timate to make, in advance of the announcement of weights by Handicapper Nathanson next Monday. Burns Handicap Day near at Hand BURNS HANDICAP DAY NEAR AT HAND. The Bjnrns Handicap will be run one week from today. Even though the weights, the great factor in such a race, will not be made public until Monday, the chief event of California racing is ; now a subject of much discussion in coast turf circles and newspapers. In general, the opinion is that the race will fall to either the Carman or Hildreth stables. People do not reflect that the formidable horses in the two stables loom large in the mind of the handicapper also and to them will certainly bo given the greatest weights. Some idea Of this may be gathered from the fact that f.or the I.issak Handicap, which will be run today. Rapid Water has been given 120 pounds; Montgomery 12": Rifleman 12:'.: Fncle US and Arimo 115. quite enough to keep them busy in a hard race. The Rums has not been a favorite's race, nor have heavy-weights had much success in it. Satsuma won it. carrying 122 pounds, hut it has generally fallen to the middle-weight or light-weight division. From the number of horses in training for the race there is a probability that more will go to tin-post than ever before in the history of the event. Magrane. was well attended and only two offered were passed— Pajaroitit. on which a reserve price of $5,000 had been placed, and Arklirta, for which $1,500 was bid, but which was bid in by S. Heather Scott Wins Again — Castile Breaks a Leg and Is Destroyed — Miller to Ride Cloyne in California Oaks. Oakland. Cal.. January 17. — For the third consecutive time this season the veteran trainer, Harry M. Mason gave the local race-going public a pleasant experience by sending a horse to the |K st lit and ready for a liest effi rt. and which made good at the first asking. Mr. Mason did not find it necessary with Orninz, the winner of the first race today, nor with his winning predecessors. Herodotus and Wood lander, to run them in races for work in order to key them up to that point where they could be backed with such absolute certainty of getting a run for one's money. Neither did he try to keep the brilliant private trials of his horses from the public, but. on the contrary, took every body into his confidence, with the result that he had to accept very short odds about them. Nearly, all the wagering in the first race centered on W. O'B. Macdonough's improved Ossary — Lovelight thnje-year-old maiden, Ormuz. Walter Miller was in the saddle and Ormuz's victory was of the cantering kind. Barney Schreiber backed his Bannock Bob very heavily and laid against the winner. Bannock Bob Buffered from early crowding and lost his rider, but escaped unhurt. Another favorite in Chitterlings rewarded his backer- in the juvenile race, which was next decided. After that the choices all went down to defeat. Jaco'.uo in the third race, with Miller up. finished last. McCafferty's horse was palpably unfit to race. Miller's connections had appealed to the stewards during (lie morning to excuse the jockey from taking the mount, but Mr. Nathanson's reply was that, although they were cognizant of Jacomo's soreness, they had decided to allow him to start anyway, but that Miller would be fully protected in the event that the horse ran a bad race. The official veterinary fa'Ied to report Jacomo's unfitness. Judge K. C. Hopper said after the race that he had not perceived any unusual or alarming signs of soreness in the horse and that he went to the post in apparently good condition. During the running of the fourth race Castile, the .*5 to 2 favorite, broke his leg and was subsequently destroyed. Matador, at 13 to 10, was unable to deliver the goods in the fifth, and Sidney 1'., another at the shortest odds quoted in the last, wound up a disastrous day's sport by just failing of his mission by a head. Heather Scott. Arcourt and Cloyne in that order were the successful horses in the last half of the card. Walter Miller has been engaged to ride Cloyne in the California Oaks. He will also ride Montgomery in tomorrow's big stake, the Lissak Handicap. Since Frank Keenan assumed charge of selecting mounts for the champion jockey his success has been marked. Miller's other engagements for tomorrow are Mansard, EI Ph-aro, Burleivji, Margaret Randolph and Blanche C. Today W. K. Applegate turned MM over to the California Breeding Bureau.- Colonel Dan Burns also donated Colonel Wheeler. Eddie Lynch, the crack lightweight jockey, re cently suspended. " lias re-entered the public schools and will complete his education. It is said that Judge Joseph J. Burke, the noted racing judge of New York, will be offered the posi-■ tion of presiding judge and steward at the Seattle meeti'ig next summer. Rumored Thomas Will Quit Racing RUMORED THOMAS WILL QUIT RACING. New Y"ork, January 17. — It was rumored among turfmen yesterday that E. R. Thomas would retire from the turf and that he was looking for purchasers for a number of two-year-olds secured last season. It was also stated that Thomas had declared all of his two-year-olds out of their stake engagements and had failed to make entries to the Beacon, Independence and Introductory Steeple chases, which are decided at Sheepshead Bay. Those who discussed the matter said that Thomas was piqued over the Jockey Club's action in ruling "Boots" Durnell off the turf, inasmuch as Thomas had offered Durnell a $15,000 contract to train a big stable for him this year. Durnell, it is said, had practically accepted the offer when the Jockey Club's edict was made known. Otogo Has Been Well Engaged 0T0G0 HAS BEEN WELL ENGAGED. Matt Allen has entered Otogo. the two-year-old chestnut colt by Ornus — Irksome, which he pur chased of J.W. Russwurm of Nashville last fall for James B. Brady, in the Flatbush. Great Eastern and several fall stakes as well as the Lawrence Realization of PmiO. Ciiless' Otogo proves a disappointment he will surely he in the Coney Island Jockey-Club Stakes of l'.rno. Allen regrets that he does not own any sort of a three-year old now to name for the stake this year, and says: "That 80 to I of the Coney Islaud Jockey Club Stakes looks good to me. A $25 entrance for a $25,000 stake is going some. Why, If you pay stariiug fee you have over 70 to 1 for your money." .
