BRISK WARFARE IN A COURT ROOM District Attorney Elders Detectives Have a Lively Time in Securing a Grand Jury Witness New York July 24 The Adams police court Brooklyn was the storm center this morning In the race track war The trouble all grew out of an effort that acting District Attorney Elder made to compel the attendance of one Martin Browle a bookmaker before the grand jury to testify as to alleged statements that he was reported as having made charging that the police were extorting money from the bookmakers at the track for the privilege of making bets and carrying on their business Elder sent two of bis detectives to serve a sub ¬ poena on IJrowle requiring him to appear before the grand jury at once onceBrowle Browle had been arrested yesterday at the Brigh ¬ ton Beach track charged with violating the betting law and was released on bail with the understand ¬ ing that he was to appear in court this morning in answer to the charge They found Browle await ¬ ing arraignment The court was not in session Magistrate Tiglie not having arrived and the de ¬ tectives made known their mission to Browle at once Browle informed the detectives that acting on the advice of counsel he would have to lec to go with them Thereupon they started to Browle whereupon his attorney Eilpcrin quickly jumped iu l etween shouting You have no right to take this man Where Is your subpoena Show your authority authorityThe The detectives withdrew from the room and tele ¬ phoned to the district attorney for assistance ami three more men were sent around to the court courtThe The five men then moved on Browle and again Eil eriii intervened and called for help to prevent the police ollicers from taking tin man For a few minutes the tension was intense and it looked as though there would be a clash l etween the opposing interests but the detectives decided to call again on tins district attorney before risking an encounter and ascertain what was best to do doElder Elder quickly arrived in person and directed the detectives to take Browle before the grand jury Tin detectives formed a flying wedge and were pushing Browle toward the door to the accompani ¬ ment of the upsetting of chairs and shouts from the crowd when Magistrate Tiglie walked briskly in and rapped for order and the struggle stopped The magistrate explained to Browle that be was at liberty to go liefore the grand jury and the whole party left quietly for the court house Browle was ushered at once before the grand jurors where lie denied emphatically that he had made any state incut to tlie effect that the polici were exacting toll from the bookmakers and denied tlait such was the fact He was excused after having been in the grand jury room only a few minutes Later be was held under bail by Magistrate Tighe for exami ¬ nation on July 30 on the charge of bookmaking bookmakingThere There was no Indictmomt handed down today by the grand jury in the betting cases and It Is prob I able that on Monday or Tuesday next the grand jury will adjourn for a two wcelxs rest restDistrict District Attorney Clarke of Kings county will return from Europe and assume charge of his ottice September 1 Elder the acting district attorney denies that lie will resign but a good source Is authority for the statement that Elder will be relegated to the background when his boss comes back backIt It is rumored that Elder Is at present engaged In trying to have the grand jury indict Schuyler L Iarsons of the Coney Island Jockey Club on the same grounds that brought aliout the indictment of Messrs Fitzgerald and Engemau This Is Derby Day At Seattle.
