Milden scored bis lirst success on the California turf at 'Oakland today with The Vicar. a degenerate full-1rother to the wonderful Whitnev flll.v. Bumble lice, which met an untimely end while lieing prepared for the Futurity of 1904. It is certain that no money consideration would have induced Harry Payne Whitney to part with this thoroughbred when foaled, yet he was sold last fall for an insignificant euui. It. was n simultaneous graduation from the niuiden ranks for both, the Whitney cast-off and his diminutive jockey, F. II. King, who was so flustered by the experience of riding his lirst winner that he made no attempt after the finish to enter the circle reserved for winners in front of the iudges' stand with his liorse. until repeatedlv signalled by the attendants to do so. The grandly bred Hamburg Vespers gelding proved immeasurablv superior to Ills numerically strong opposition, but ran practieallv uribacked. the closing odds against him being 9 to Booger Hed and Don Enrique were the onlv legitimate favorites on the program and they lwtli made good handsomely. The remaining short-priced starters. Wamboro. Deneen, Serenade and Gene Itussell. were of the ring-made variety and their defeats could not be properly classed as upsets, the horses which prevailed over them in their respective races being undoubtedly the best and quoted at false prices in the betting. Following so closely on Tuesday's extra good card today's racing was in the nature of a surprise, as good horses were plentifully engaged in at least half of tho races. II. Smith, a local jockey ruled off several vears ago. was reinstated today iby the stewards of the Pacific Coast Jockey Club. The track is drying out rapidly and tomorrow's races will lie run over good if not fast going. On the whole today's ring business resulted favorablv for the layers. Wagering is steadily increasing and at today's cut-in thirty liookmakers drew for positions. The forward running of Barney Sehreiber's Dr. Ilolzberg in the last race was one of the racing features of the. afternoon's sport. Gene Russell's four legs were heavily bandaged todav and in consequence he was seemingly unable to raise a respectable gallop. Sir Lynnewood made his lirst public appearance since the July Brighton Beach meeting. The big Kir Dixon horse was given an easv ride by jockev Gilbert, had no chance in the stretch and was pulled up. yet finished a close up sixth. .Starter Dwyer suspended two incompetents. Wris-pen and McBeth one week apiece and Buxton for three days. Foundation for Test Case Laid: Race with Betting is Run at City Park and All Concerned Are Arrested FOUNDATION FOR TEST CASE LAID. ' Race with Betting Is Run at City Park and All Concerned Are Arrested. New Orleans, La.. December 1G. One race was rim at City Park track this afternoon at 2 o'clock, with four horses in the field. Bets were freely made by the detectives and spectators that crowded through the gates to witness the performance, and when efforts were made to cash in the lcts the police got busy ami arrested W. W. Lyles. or Kentucky, manager of the enterprise; Placide Fri-gerio and It 01. Sheffield, liookmakers. Affidavits were also made against Samuel F. Heaslip. president of the Now Orleans Jockey Club, and Edward Corri-gan. neither of whom was on the grounds, the latter being in Lexington. Ky. Today's test of the iLocke anti-racing law and the fireworks attending it. provide a new chapter in racing history (it New Orleans. Prior to the attempt at racing the local directors of the New Orleans Jockey Club held a meeting at noon, and declared against the test of Corrigan and Lyles. and President Heaslip asserted that unless the directors voted to refuse the use of the track to Mr. Lyles that he would resign. Despite this protest, ostensible if not real, the race was run and the arrests followed. The track was Hooded with police. The patrol wagon stood at the gate. Inspector O'Connor, acting Mayor 'Mcltaeken. and Bstriet Attorney Adams were all at t!'o track, bristling with a desire to prosecute and uphold the Locke law. Chief of Detectives Reynolds and the speaker of the house. Dupre. together with an army of over thirty policemen, were also on the grounds. The test was conducted by W. W Lyles. who is believed to have been representing Mr. Edward Corrigan. He admitted in a "speech' to the crowd that lie had received the Jockev Club's warning, but insisted that he did not Intend to violate the law. However, the law was violated according to the ollicers. Detectives Coyle. 'McOabe and Glynn arrested R. M. Sheffield and W. W. Lyles. Captain Louis Rawlins and Sergeant Leroy took charge of Placide Fri-gerio. The detectives did the betting and when the money was accepted arrested the bookmaker. Fourteen dollars was wagered. The prisoners were released on $500 bond. At 2 o'clock alKut 200 persons gathered at the City Park to see the test race. Four horses were in the race Olaycella, Billy Strong. Malceon and Mr. Knapp. The race was a quarter-mile dash. In the betting ring, with the issuance of the first tickot. things began 4o get lively and many bets were made. In the betting on the race Mayeeila opened up favorite, at -1 to 5. while the other horses were held at 2 to 1. Special Officer Joe McCabe was the first to make a liet. He was followed bv others and at last so much money was shoved at the 'bookmaker that he asked every one to get awav from the booth. No attempt was made to Interfere withthi'-lwtting until after the nice was run. and as soon as the result was announced and an attempt made to cash the ibets the police became active. When the horses were called to the post they received a royal reception. Malecon. with Duggan up. was the first to parade, and was followed bv Mav-colla. with NcHvcom up. Then came Billy Strong, with Lynch up. and the last one was Mr. Knapp. with A listen t up. Starter Sullv sent them off to a good start, and it was nip and tuck to the finish. Mayeeila winning by a scant length, witli Billv Strong a dozen lengths in front of Mr. Knapp. Tin' winner was given a hearty cheer and then the crowd all rushed in to see the arrests made. After the race tl:o only person showing a winning ticket was James 01. Smith, who wagered 2 to 1 on Mayeeila. After the arrests Inspector O'Connor declared that President Heaslip and Edward Corrigan were not ion the grounds. "If they had been," declared the inspector, "they would have been arrested." In a statement tonight. President Heaslip declared: "I was surprised today when I learned that .Mr. Lyles proposed to make a test of the Locke law. I immediately called a meeting of tho directors for today at noon and resolved' to resign if the lward sanctioned 01 r. Lyles' plan. The gentlemen who are responsible for the Lockt'. measure were sincere and 1 am sure they lielieved when they had the measure passed that they were serving the best Interests of the people. If there is to be any change from the present condition it must not be in the shape of finding a technical loophole in the Locke bill. If it develops tWit racing as conducted here for many years is essential to the prosperity of the city, this must be revealed through the voice of the community." Attorney E. Howard McCaleb has been retained by Mr. Lyles and his associates. Captain Alex Brewster, veteran of the Crescent City Jockey Club, went on the bond o all three of the ones arrested. (Bed) Walker was so well pleased with Norbitt's effort In the fifth nice today that when Associate Judge Cole placed the colt on sale for $500 he lwosted the price to $1,500 in two $500 bid. W. S. House, however, saved the colt by bidding the usual 5 extra. Fitz Herbert's performance today made a splendid impression on horsemen and public alike. He was pitted against a very ordinary band and was never fully extended at any part of the race. In case he trains on he should be a very difficult colt to beat and at present holds any two-year-old here perfectly sale. Olorlo emulated his excellent showing of last Saturday when he tied the American record. Despite the fact that he beat Colloquy that day the latter was again favorite over him, but this time was beaten much easier. Glorio holdiug her and Hasty Agnes perfectly safe all through the final sixteenth. Ben Trovato. which usually causes much merriment in the grandstand by his stringhalt movement on his way to the post, ran another good race when he beat a speedy band in the third race. Pretension, which was made favorite over him and which he beat several days ago. ran a dull race, Ben Trovato proving an easy winner. The card was well balanced throughout and was productive of an interesting day's sport. Today was cut-in day. twenty-four hooks doing business. This was a loss of one over the last roll call. B. J. Callahan and J. Humbrecht withdrew. J. F. MeConnell went on. Canadian Racing next Year CANADIAN RACING NEXT YEAR. Toronto. Out., December 1C. The racing season in this' district promises very well for the coming season and, with united action assured by the cooperation of the Canadian racing associations on all mutters of common interest, the sport which attracts the attention of more people than are concerned in any other pastime should be greatly benefited under the new regime. The practical certainty that there will be no racing at Kenilworth tills season will enable the Canadian clubs to make a more satisfactory arrangement of dates than in the past. It was not until the end of June that Kemlworth's plans were decided on last vear, whereas the other clubs are this time in a position to take early action for the coining summer. The elimination of Kenilworth from consideration does not mean that there will be more racing in Canada, but only has the effect of allowing a program that should be more satisfactory to cveryibodv. The points at which the longest meetings in Canada have been conducted are Fort Erie and Windsor, but they are gradually contracting. Last year each of these places bad fewer racing days than in previous seasons. This year the meetings are likely to 1m? shorter still, and to be divided, instead of continuous. It is not understood that the clubs have adopted a schedule of dates, though this will probably be done next month, but that there has been an exchange of views, so that when the club representatives come together they will have 'the preliminary ground well cleared. Only art approximation can be made at this stage, of course, "but even that is of Interest at present. Witli the King's Plate run at Woodbine on May 22, a later beginning than last vear. Montreal and Hamilton could follow in that order, avoiding the conflict that has been the case In otlier years, and giving Hamilton people racing on Dominion Day, which Is sure to be the most popular kind of innovation. A 'few weeks at Fort Erie, including the Fourth of July, and a few weeks at Windsor, with a return to Fort Erie for sir or seven davs. would bring the circuit up to the time for the brief fall meetings at Montreal-. Toronto. Hamilton and. possibly. Windsor. This plan would cost horse owners more in the way of traveling expenses, but that is far outweighed by the fresher and more interesting racing it will produce, and the increased attractions tlie club will offer to owners. Joyner. who has charge of the Whitney horses at Newmarket, England, reveals the fact that the American horseman is well pleased with his new surroundings and the people with whom he has come in contact. Dir. Joyner writes of his arrival and how the leople and country impressed him. lin the following manner: "We arrived sut Newmarket on the evening of October 27, at four o'clock, in a downpour of rain, and my impression of England was not very good. We unloaded our horses and rushed them to their quarters, which were about a mile from the station. Thanks to good management, or good luck, they came out of their trip in tine sliapO and have kept well ever since. Since the day we arrived the weather has 'been very- fine and I like the country and people very much. I have been to the races several times and find the racing different from jurs. Nearly all their races are run over straight courses, and there is only one turn in any of their races. Of course, this applies to the courses where I have been. The training is very different. "The gallops are all on the grass, and whn one is used a while they shut it off and open another one. Some of the gallops are three miles from my stable, so you see a fellow lias to hustle. They have some tine horses over here and they are larger on an average than ours. The trainers are all a lot of fine fellows and have lieen very nice to the. They have fine homes and entertain. A trainer here Is looked upon as a gentleman in Ids profession and every one looks upon him as such. They are all thorough horsemen and know Iiow to trail their horses, which look well. Of course, their methods are different from those in the States. I have won a pony or two since I came over. The most up-to-date course is one at Newbury. It is 'built on the lines of our courses, has a mile straight and two miles witli one turn. The sand is modern and they have chairs on the lawn, much like Belmont Park. The train service Is line to that place. We went sixty miles in fifty-six minutes. I think I like the racing over here. "Of course, a horse can't run as many races as in the States, because they are continually traveling, as the meetings at no place are over four days, and most of them are from oue to two. There is more racing at Newmarket than anywhere else. They have eight meetings of from three to four days each; On every course they have a stand exclusively for trainers and jockeys. Macdonough has disposed at -private sale of all the yearlings bid in at his recent paddock sale at Oakland. The West Virginia Fair Association will hold a race meeting next June at their new track in Parkersburg. W. Va. Herman Conkling has been appointed clerk of the scales and Elmer Wilson will be the starter at the Savannah Jockey Club meeting, which will begin on Christmas Day. Starter Holtman has ordered Miss HImyar and Byron placed on the schooling list, their unruly tactics at the post in a recent race at Santa Anita Park being the cause of this order. The annual meeting of the stockholders of the Saratoga Racing Association for the election of directors, etc., will be held' at the olllce of the association on Thursday, January 14. 1909. It appears now that Sewell, the crack sprinter of the El Nldo Stable, has developed a severe case of skin disease, which probably accounts for the poor showing of the horse in his last few races. Jockey Schleslnger sustained a painful but not serious injury the other day at Santa Anita Park while exercising a fractious two-year-old. The Ally ran away and after throwing the boy dashed through the entrance of the track, but was afterwards found In her own stall without suffering any apparent injury. Jockey. McCahey, who has about recovered from the effects of the Injury to his foot sustained last summer at Baltimore, had his first mount since that accident at Santa Anita Park last Monday. Racing will be one of the prominent features of the Winnipeg Exposition to be held next year and over $20,000 will be distributed in purses, to be equally divided .between the runners, trotters and pacers. An ordinance prohibiting poolrooms throughout Los Angeles County, Cal., was passed bv the supervisors of that county yesterday. The penalty for such an offense is a $500 fine or six months' imprisonment in the county jail. The New California Jockev Club has secured new quarters in the Colson Building at Stockton and Geary Streets, San Francisco. An entire Hoor will be occupied by the Jockey Club officials about the first of February. Willie Simms, at one time one of the leading riders Jn this country, and who lias not ridden for several years, is going to Savannah, where he will get in condition 'to take his place in the saddle again, as he intends to go to France in the spring. Tommy Burns will also ride at the southern meeting. Kirk Le Seur has a yearling full-sister to the sensational .Tack Nunnally. The filly is a light bay. toy David Tenny Lillle W.. and is said to be a better looking yearling than her illustrious brother was. Le Seur also has a two-year-old filly by David Tenny Nina, which he has named Bonnie Selway. and of which be entertains great expectations. The sister to Jack Nunnally is a bit 'backward in her training, due to an accident while running out. but will be ready for racing before the Oakland season ends.
