Hawkins, of Midway. A. E. Hundley, of Dan rifle, and John B. Kwing. of Lexington, against the Adams Express Company, was begun in the Circuit Court this morning. The plaintiffs claim damages aggregating 15.000, alleging that a carload of thor oughbrejl yearlings shipped from Lexington. June ].Y 1MB, were damaged that amount through ncgli geaee, carelessness and delay on the part of the company in furnishing a defective cur. The~trial will occupy about two days. The Street Railway Steeplechase had but four starters and developed into a keenly Contested race. Byzantine and Pagan Bey raced as a team for the Inst two miles, with Kara and Steve l.uiie In close pursuit. Byzantine tired badly on the last turn of the ticld. but succeeded in winning. Kara and Steve Lane were overtaking him In going to the last jump when Ray. on Byzantine, crowded them to the outside and caused them to pull up. Claims of foul were lodged by both McAfee and Simpson, hut were not allowed. William Garth's Busy met and defeated Flying Squirrel in the Tyro Selling Stakes, which the latter seemed to have at his mercv. Plying Sijuirrcl was one of the best hacked favorites of the afternoon. Ret tig was overconfident and was criticised for losing the race. J. J. Walsh won his first race of the meeting when Sir Bdward easily disposed of a band of sprinters in the opening race. Chicagoans will doubtless be surprised to learn that ( Council, a horse of brilliant speed, whose achievements won for him a loyal following among Chiccgo race goers during several seasons over a decade ago, is still alive. D'ConneH's racing career caiiic t lose in 1900 under dramatic circumstances and he has since been occupying, a stall at the liar Iciii rare track, a pensioner on the bounty of John Condon. Mr. Condon came Into possession of the I or o as a result of his well known aversion to any thing approaching cruelty where dumb beasts arc concerned. The last time that O'Connell appeared under colors, .his underpinning "as '" s'tch condition (bat il was deemed necessary to etherize his legs ami feci. He made a gallant effort, but unit on account of his aching feet after leading his held into tin- stretch. He came out of the race in such apparent distress that Mi", t.'oudon. moved to pity, forthwith decided to buy the home and give him honorable retirement. At the end of his racing career. O'Connell was running In the colors of J. J. Barron & Co.. hut his leal owner was the track feed man. Costello. Mr. Condon, in buying the horse, upbraided owner and trainer severely for having submitted the old campaigner to the treatment which amused his indignation. Since theu O'Connell has hail nothing to do but munch oats and hay to his heart's content at Harlem in company with several other horses that Mr. Condon has pensioned off after faithful service. O'Connell is now nineteen years old and first raced as a three year old. winning his initial start at Hawthorne in IMS in the colors of the Kentucky Stable. In a race on October II of that same year, an attempt at a killing on him resulted disastrously. Tee Nuke beating him easily. As he won his sue (ceding seven starts, there was abundant opportuuiti for recouping the lossi s Incidental to the betting coup that failed. As a four-year-old he failed in his first few starts on eastern tracks, but coining west earned a most meritorious record by winning ten races out of thirteen starts at Cincinnati and Baby. His victorious career was continued (he succeeding year, in which he won thirteen out of eighteen stalls. As a six -yeui old lie Started only twice and finished second on both occasions. At seven, eight and nine years, his showing was remarkably good for a horse of his age. Not until his linul year of racing did the inlirmities of his increasing years materially affect his running Qualities and not ni.na Auicican horses have a better record than O'Connell earned during his career of eight years in training. Out of a total of 120 starts, he has sixty victories to his credit and was unplaced only seventeen times. His winnings aggregated almost $25,000. Following is his record in detail: O'Connell, b. K. SIR MARTIN'S MISHAP IN THE DERBY. New York. June 5. — John K. Madden today re ceived I letter from trainer Thomas McCreerv. who accompanied Jockey Walter Miller to Knglaud. in which the writer states that Sir Martin did not tail in the Derby contest, but that jockey Martin was unseated, or fell off. McCreery was of the opinion that crowding at the sharp turn at Tattcn-liam Corner unseated the Auiericau rider. Coutinu bur. McCreery says: "Sir Martin showed no ill effects from his Derby experience and is going soundly. lie looks pounds better than he did last year, carrying much more desh. June 5. — The third annual spring meeting of the Montreal Jockey Club began today under circumstances that augur well for its success. Despite adverse climatic conditions a large crowd turned out and long before the horses were called to the post for the oiiening event, the grandstand was tilled. Besides the King's Plate, there was offered a feature In the St. Lawrence Handicap. The King's Plate proved easy lor Rolicrt l'razer's S. S. B.. which came from behind in the stretch and won iu a canter. The other fixture furnished a stirring contest in which Jack Parker managed to stall off Guy Fisher's determined stretch bid and lasted to win by a scant length. The start, which was none too good, affected the result. The held was sent away to a walk up break. Jack Parker had the best of it and Guy Fisher was last to leave the post. This disadvantage proved too great for Guy Fisher to overcome, although he made a gallant effort. Favorites scored in live races, but as four of them were at odds on. the layers did not greatly suffer. Jockey Goldstein rode two winners ami Hinchcliffe. another of Captain Presgrave's riders, had the mount on Wild I'irc. winner of the closing dash. King James carried more thsh than any horse in tlie Brooklyn with the possible exception of Celt and his coat had that rich gloss that betokens period health. Concerning King Janus' Brooklyn Handicap victory. Mr. Hiblrcth said: "I felt confident of winning. King James is a speedy, rugged and honest horse. He seems to thrive mi hard work. That trip to Canada did not hurt him. as some people thought it would. He is not so tall, but he is a big horse. Last fall he split his loot and was out of training for only a mouth. I tint a bar shoe on the injured foot, which healed nicely, and now he has good feet all around. He is in everything I could get him iu. "I suppose Mr. Yosburgh is right now figuring how much he can carry. Of course he had to be hustled to beat Rcstigouchc that wav weighted. Last winter, in California, I wasn't sure but Resti-gouehe was the best horse I had oyer a distance. He is all right when you let him run as he likes.
