Favorites Fail Backers: All of the Public Choices Beaten at Latonia Yesterday FAVORITES FAIL BACKERS ALL OF THE PUBLIC CHOICES BEATEN AT LATONIA YESTERDAY. Some of Them Meet with Mishaps and Have Satisfactory Excuses Barney Schreiber Misses ,i Another Opportunity, t Cincinnati. O.. July 2. The hackers of favorites were put to complete rout this afternoon at Latonia, :is six first choices sustained defeat. It was the ihost disastrous day. in a speculative way, that race-goers have experienced since the current meeting began. In several races the defeats of the favorites came as the result of some mishap which was exasperating. The chief incident of the afternoon was the leaving of Joe Kose at the post In the fifth race. To those closely watching the maneuvers at the post it appealed that the arm of the barrier attached to the outer rail failed to release itself, therehy preventing Joe Hose from starting. To others it seemed that the horse was unprepared and had the barrier in Ins mouth when Iloltiuan gave the order to go. Joe Kose, which had been purchased yesterday by II. (I. I5edwell. was accorded especially heavy hacking. The Hedwell representative figured prominently in the last three races. Madman won the fourth race, the feature of the program, from Charlie Kastman. In the closing race, another one of Bedwell's recent acquisitions failed by a narrow margin, Hans leading him to the finish. The most serious demonstration of the meeting followed the finish, the crowd congregating about the stand and shouting for Belleview in the belief that the judges might lie inllueneed to reverse the placing. The demonstration was uncalled for as Hans won by a good heart, Bedwell thought that the winner was entered too cheaply at $600 and promptly raised him to $1,200. at whicli figure the colt became his property. Barney Schrciber's Banives. running to his best form, defeated an ordinary band of youngsters in the second race. His owner again neglected an opportunity to win a profitable wager by his failure to hack the colt. Sclueiber did attempt a coup in the third race on Luliin. The horse encouraged his backers greatly by going into what appeared a safe lead at the stretch turn, hut Quagga came with a great rush at the end and won on". Lubin retaining second place. '.Miss Crawford, formerly a good nicer, was also heavily backed, but she failed to become a serious contender. Fifteen maidens met in the opener, and James iri0in took down the first purse that has rewarded lilm since his return from California, when Dextrine :amc home before the poorly handled and frequently interfered with Tannic. Condensed History of the Coney Iland Jockey Club Stakes r CONDENSED HISTORY OF THE CONEY ISLAND JOCKEY CLUB STAKES : Tlie Coney Island Jockey Club Slakes is the race established, by the Coney Island Jockey Club to take the place of the American Derby in American racing, after Mayor Carter II. Harrison had taken the measures that resulted in the abandonment of racing at Washington Park. Since it was first run in 1007 its history is necessarily of the brief order and it is to be contested for the third time this afternoon. In its first two years of running It was a guaranteed race of $25,000, with a further contingency of $10,000 if its winner also carried oil the Tidal Stakes and Lawrence Realization. This year it is only of the value of $2,500 and the chance to win that extra $10,000 has gone glimmering. The idea at the bottom of the foundation of this race was distinctly creditable to tlie Coney Island Jockey Club and it will lie surprising if the race is not restored to something like its former dignity within the next year or two. Colored Rider Who Shared Honors with tho Horse -Has Close Call Later in Day King James Doing Well. New York. July 2. The Oneck Stable's colt. Fashion Plate, and the.eolored rider. Henry Smith, made a winning combination in "the Sir Walter Handicap at Sheepshead Bay today. Horse and rider covered themselves with" glory and 8,000 spectators bestowed on them generous, applause. The Woolsthorpe three-year-old made .important weight concessions to tlie quartet of good horses of more mature age opposed to him and vanquished them, so rtecisivelj' that, racegoers are ready to acclaim him a horse of stake caliber. It Is now conceded that had Fashion Plate not been pulled up at the -start he might have placed in the Suburban. Messrs. Knapp and Karrick.. re spectively owner and trainer of the colt, were the happiest men at the track, and were particularly anxious that no one should overlook the really remarkable ride put up by Smith. The colored boy's day of triumph terminated inauspiciously when Coonskln. a starter in tlie last race, reared, fell and rolled over him while on her way to the post. The attending physician announced that beyond a few minor bruises Smith escaped injury, hut It looked like a close call. This was an extra day of racing witli a special overnight card that filled well. Tile weather conditions were Ideal, the track was exceedingly fast and the biggest off-day crowd of the year was in attendance. Results were somewhat awry from a form viewpoint. Black Mate, at 40 to 1. inaugurating ' a series of upsets with tlie first race. The other winning outsiders were Tim Pippin. Evening Song and Beauclcrc. The sudden recovery of speed by tlie last-named, coincident with heavy backing, created some surprise. In none of ills previous races this summer had Beauclere been able to raise a respectable gallop. The unseating of II. Smith by Coon-skin caused a delay of ten minutes In the starting of the last race. J. Creevy was finally substituted. Betting shifted materially (luring this, interval, the closing odds against Niagara, the winner and probably a, real clinker, receding to 3 to 1, while St. Dunstan was backed down to S to 5. It is rumored that Eddie Dugan will go to Canada to ride In tlie near future. S. C. Hildreth stated today that King James has fully recovered and is in grand form, but will be reserved for the Saratoga meeting. - Seventeen racers in training, belonging, to. the SIN verbrook Stable, at present in charge of Thomas Welsh, have-been turned over to R. Miller to train. W. S. Fansiiawe is tho owner of this big racing establishment. Condensed History of the Great Trial Stakes T T CONDENSED HISTORY OF THE GREAT TRIAL STAKES Heretofore tlie Great Trial lias been as distinctly the Coney Island Jockey Club's most valuable fixture for two-year-olds of its summer meetings as lias the Futurity of its autumn meetings. Its guaranteed value last year was $25,000. Tills year it is of just one-tenth of that goodly sum. It Is not so old as the Futurity, baying first been run in 1891, when, it fell to that remarkable two-year-old. His Highness. Kentucky State Racing Commission Turns Down Application Tiled with It. Lexington, Ky July 2. The Kentucky State Racing Commission, with Messrs. E. F. Clay, Milton .Young. Charles F. Grainger. Louis des Cogncts and Secretary Rouse present, met here today and refused to grant the application of the Paducah Fair Association for a license to give twenty-one days of racing, beginning July S at Paducah. The commission was addressed in person by Harry White, general manager of the proposed meeting. Mr. White read the application, which was signed by Ben Weille. president, and Rodney Davis, secretary of the Paducah Fair Association. The application was dated June 2S and named Frank J. Bryan as presiding judge. James Milton, starter. George Dillon, clerk of the scales, and Harry White, racing secretary, hamlicnpper and general manager. Mr. White explained to the commission that the association would give live races of the total value of $1,000 daily. He was asked what form of betting was intended and replied that he could not say whether , or not bookmakers would be in line. 1 The commission then called Mr. White's attention to that section of the law creating the State Racing- Commission which requires that applicants for dates must be made thirty days in advance of the first -day of the proposed meeting and members of the commission assigned as reason for tlie denying of the license the fact that application had not been made at the proper time. 'Mr. White's attention was further directed to a section of the law which gives to every regularly, organized fair association in the state the right to conduct six days' racing annually without license or sanction from the commission. A communication was received from R. L. Thomas stating that jockey .Shilling had jumped his contract with him and had entered the employ of Irving II. Wheateroft. Mr. Thomas asked that tlie commission rule upon Shilling's right to leave his employ and Mr. Wheatcroft's right to his services under tlie circumstances. Secretary Rouse was directed to notify all parties to make answer at a meeting of the commission to be. held Wednesday, September S. Improvements at Churchill Downs: Matt Winn Tells of Them and Also Makes Interesting Statement Concerning IMPROVEMENTS AT CHURCHILL DOWNS. Matt "Winn Tells of Them and Also Makes Interesting Statement Concerning Juarez Track. Cincinnati. ()., July 2. Matt J. Winn, in discussing tlie fall meeting at Churchill Downs, hart this to say: "I look forward to splendid racing this fall. The spring meeting at Churchill Downs was the greatest in the history of the sport in Kentucky. Everywhere the friends of racing are still talking about it. I heard of it in New York. "The public is not aware that many costly improvements have been made at Churchill Downs since the races. The clubhouse and grandstand have been repainted and a new main entrance lias been built. This includes a canopy from the place where the street cars stop to the grandstand. New ticket olhces have been built. Other improvements have also been made looking to the comfort of patrons of the club." Colonel Winn incidentally remarked that although nil memberships in the New Louisville Jockey Club had expired, such memberships will be recognized this fall, as was done this spring. The membership list is limited to 200, and the present members will bo accorded first chance to renew memberships in 1910. Relative to the opening of the Jaurez meeting. Colonel Winn made this statement: "(iraini'er & Co.. of Louisville, have the contract to furnish the steel work for the grandstand. .Stevens & Co., of Chicago, will put up the steel work, including the concrete work. James Murphv, of the firm of I). X. Murphy & Co., of Louisville, is now at Juarez superintending the work in general. About 400 men are at work on the plant. It is jMisitlve that everything will be ready by Thanksgiving Day. The El Paso Street Railway Company will build double tracks to the race track, and the time from El Paso to the course will be ten minutes. "The track will be a mile and an eighth and it will lie a duplicate of the Santa Anita course. The soil Is such that the course will he fast. We will not build a hotel at the track tills season, as planned, but will do so later. El Paso lias four or five good hotels. Juarez will see the greatest racing ever giveu on a foreign track by Americans." Hildreth Engages Jockey Powers HILDRETH ENGAGES JOCKEY POWERS. New York, July 2. S. C. Hildreth lias engaged Vincent Powers to do most of the riding for his stable and Powers will pilot Fitz Herbert in the Lawrence Realization, when the Kthelbert colt meets the fleet-footed Hilarious. When Hildreth starts two horses in a race lie will get Dugan to help Powers out whenever the services of that lad are available. Hildreth is especially partial to Dugaifs riding, but lie could not secure the lad, August Belmont having acquired a prior claim. Powers came east to ride Thomas C. McDowell's mare. King's Daughter, in the Suburban. He brought an excellent reputation out of the west, and exacting eastern critics agree that he lias math? good. Powers is a young man of considerable intelligence and much energy. He is alert at the post, he understands pace and he finishes stoutly. Uncle Again in Training UNCLE AGAIN IN TRAINING. New York. July 2. Uncle, the four-year-old chestnut colt by Star Shoot The Niece, for which S. C. Hildreth paid John E. Madden $.,I0) as a two-year-old. is once more in training at Sheepshead Bay after having been on the shelf almost continuously since his transfer to Hildreth. Uncle won several races for Hildreth during the fall following ills purchase, then fell a victim to foot trouble on being taken to California for a winter campaign. Several times in the interim Hildreth has almost got Uncle up to a race, only to have him fall lame at the last moment. Jockey Miller Gets License JOCKEY MILLER GETS LICENSE. London. Eng.. July 2. Walter Miller, the former champion American jockey, today received a license to ride from the English Jockey Club and will immediately be seen in the saddle on the English tracks. He has kept in condition by exercising horses since his arrival in England. Selling Platers Given Chance to Win: Little Class to Yesterday's Racing at Hamilton-Big Run-Up Follows Victory SELLING PLATERS GIVEN CHANCE TO WIN. Little Class to Yesterday's Racing at Hamilton Big Run-up Follows Victory of Little Osage. Hamilton. Ont.. July 2. Today was an off day at Hamilton. The program was made up of sis races, the conditions of which were framed with the idesi of giving tlie iioorer class of horses an opportunity of winning. The fields were evenly matched, however, and in n majority of instances keen contests resulted. Light showers fell during the afternoon, but they in no way interfered with the racing and the track remained fast. P. T. Chinn's Canadian Derby candidate. Piute, was given his final 'preparation for that stake in the third race, a six-furlongs dash that brought out some fair sprinters. Piute carried top weight of 114 pounds, and was ridden by Preston, who will have the mount on him in the Derby. In the early stages Piute droped out of the running, but in the final quarter he closed courageously and at the end finished lapped on Personal. The latter, showing keen speed at till stages, essayed to make a runaway affair of tlie race. Piute was worked out a mile in a trille under 1:40. Many stables left this morning for Fort Erie, to lie on hand for the opening on Monday. A special was made up of six cars and carried most of the tiig stables that have taken part in tlie meeting. Many more will leave in the morning, the horsemen being anxious to get settled In the new quarters. The first big run-un of the meeting came after Little Osage had galloped home an easy winner in the fifth race. Little Osage made his opposition look cheap and won in a romp. He was entered to be sold for $000. but was carried up to $1,400 by Guy Gray, son of old "Uncle Jlmmic Gray." J. W. Bauer, owner of Little Osage, protected his horse and bought him in at $1,40.",. John Dynient today purchased of William Gartli the steeplechase mare. Wild Refrain. The latter was badly cut down in her last race. She is a well-bred mare and Dynient purchased her with the idea of breeding a Kingjs Plate winner from her. Jockey Guy Burns arrived from New Y'ork this morning and will ride on tlie Canadian circuit for the balance of the season as a free lance. R. J. Walden will ship his stable to the Walden farm at Middleburg. Mil., on Monday to rest up his horses until the opening of tlie fall meeting at Pim-lico. Schreiber Was Advised Not to Bet: His Trainer Entertained Poor opinion of Dr. Waldo Briggs, Winner at 200 SCHREIBER WAS ADVISED NOT TO BET. His Trainer Entertained Poor Opinion of Dr. Waldo Briggs, Winner at 200 to 1. Cincinnati. O.. July 2. The victory of Barney Sehreiber's Dr. Waldo Brlggs at 200 to 1 at La-tonia yesterday was still a fruitful topic of discussion when race-goers gathered at the track today. It transpires that one Individual, a veteran race player of this city, pulled down $1,100 on an investment of $7. some of the money being played for place and show. George North was stung about tlie hardest of any of the bookies, losing $500 to the race. A few other bettors had tickets calling for $400 to $2, and there was more play for the place and to show. The maddest man at tlie track was Barney Schreiber. for lie did not bet a dime ou his horse, and did bet $200 on Richard Reed. He just raved after it was all over, and. when some one approached him, he would say, "Feel my head; I'm going crazy." Why he did not bet is best told by Barney: "Those trainers of mine have got me going, there is no use talking about it. I named the colt after Dr. Briggs, of St. Louis, a fine gentleman and a good doctor. He examined me a few years ago and declined to accept a fee, and I said at tlie time I would name the best colt on the farm after him. I thought I did at tlie time, but the trainers never got this one to tlie post as a two-year-old. " 'No account.' was tlie report handed to nie, and they did not want me to take him away from the farm. Sell him for a buggy horse was the advice they gave me. But I got them to take him along, and today I saw him breezed a quarter in 22.?. but I was told not to bet, as he would be sure to stop." Tuesday to be an off Day: New York Race-Goers to Have Five Days of the Sport next Week TUESDAY JO BE AN OFF DAY. New York Racc-Goers to Have Five Days of the Sport Next Week. New York, July 2. Next week will again see five days of racing at Sheepshead Bay. Tuesday will be tlie off day. When the season liegan on the metropolitan tracks three days a week were considered good enough, but the Jockey Club promised to add extra days If the patronage instilled it. The patronage has justified it. and iMr. Belmont and his associates have made good their promise. There is no mistaking the TMpularity of the sport as now conducted. The week-day crowds compare favorably with those of the open betting ring regime, tlie enthusiasm is just, as great and the sport just as thoroughly enjoyed. With Empire City following with six days a week, and a full four-week's sport at Saratoga, the game promises to lie as successful as in any previous year. Furthermore. It. T. Wilson. Jr.'s recent purchase of twenty yearlings, the get of Ogden. Planndes and Yankee, is" regarded not only as the biggest transaction of its kind in years, but as an exceedingly good sign of the times. The terms were private, hut it is known that the amount involved was large. This deal is an evidence of the confidence that the president of tlie Saratoga Association has in tha rehabilitation of racing. Plaudit Coming Back to America PLAUDIT COMING BACK TO AMERICA. New York. July 2. John Madden lias decided to recall Plaudit, the Himyar Cinderella stallion to whom the American turf is indebted for King James, from France. Plaudit was sent abroad last fall when racing on this side of tlie Atlantic looked rather uncertain. Mr. Madden thought at the time of getting a stud together in France, as Herman B. Duryea and Mr. Belmont were planning to do. Since tlie development by King James of championship form, the Kentuckian lias decided that Plaudit will be more useful to him at Hamburg Place. Vanderbilt's Winnings for Year $160,400 VANDERBILT'S WINNINGS FOR YEAR $160,400. Paris. France, July 2. W. K. Vaudcrbilt heads tlie list of winning owners on the French turf since the racing season opened on March 12 last, his horses having won $Ki0.4iO up' to June .'50. Maurice Rothschild comes next with a total of $121,200. Baron do Rothschild's horse. Verdun, was the greatest single winner, SUO.ooo. including the $75,000 Grand Prix. Mr. Vanderbilfs Oversight comes next with $61.txx to his credit. Tlie Prix Cote d'Or at Enghien todav was won bv T. P. Thome's The Snob. Mr. Thome's Boui ran in the Prix Forez. but did not get a place. Nash Turner started Villegh.ture and W. K. Vaudcrbilt Lillian in the Prix Cliarolals, but neither horse showed. In the Prix Bourgeogne Turner's Don Quichotte III. and J. E. Widener's Sheriff Williams were among the starters, but neither secured a place. Horses Coming from Far West HORSES COMING FROM FAR WEST. Salt Lake City. Utah. July 2. Two carloads of the best horses that raced at the recently ended meeting at the Fair Grounds have been shipped to Fort Erie, Ont. In tlie shipment were J. II. Bran-non's Booger Red. Cabin and Fred Bent: L. T. Lee it Sous' Blagg, Salvage, Coppers, King of Yolo and Knight Deck, and J. O. Holder's Uazlct and Strike Out. Danny Maher Need Not Worry DANNY 'MAHER 'NEED NOT WORRY. London. Eng.. July 2. Danny Ma her. who is talking of retiring from tlie saddle, has achieved greater success and popularity in England than auv other rider from -America, not even excepting Toil Sloan. The performances of Sloan some years ago were astonishing to Englishmen, but Sloan could not endure here while Maher lias had greater success year after year. This is due In great part to Malier's adaptability .and thrift, and the American is now a thoroughgoing Briton. Maher has made a great fortune for a jockey and will tot need to worry over his enforced retirement. Keen Interest in Fort Erie Opening KEEN INTEREST IN FORT ERIE OPENING. Buffalo, N. X: .Tuly 2. The keenest interest continues to be manifested locally In the running of the Canadian Derby on .Monday at Fort Erie's opening. It is the principal topic of conversation at tlie local sporting resorts. The meeting here for the first time of horses that have been racing in the west and those that follow the Canadian circuit invests the races with greater interest than "would otherwise prevail. Olamhala seems to lie the general favorite of those looked upon as likely starters. There is a lot of talk, however, about Plate Glass. W. J. Young's entry. Jeff,- Bernstein. Marse Abe and Piute will all have followings. All the Derby candidates will be at the track by tomorrow. Horses are arriving by the carload daily. Applications for stalls were greater than ever before and the indications are' that every record Fort Erio has known will bo broken. Brighton Beach Will Get Dates: Its Obligations to Horsemen Must be Discharged as Necessary BRIGHTON BEACH WILL GET. DATES. Its Obligations to Horsemen Must Be 'Discharged as Necessary Preliminary. However. New York. July 2. Will there be a fall meeting at Brighton Beach race track? The fences have been torn down, the field stand and stables have been carted away and a part of the infield has been filled in. preparatory to tlie laying out of building lots. Tlie big steel grandstand, tlie comparatively new clubhouse and the paddock, with its stalls and jockey buildings, are intact. The track, covered with grass and weeds, simply needs the harrows. . "In ten days the Brighton track can be made ready for racing." said a man close to William A. Engeman yesterday. "We can put up new fences and harrow tlie course 'without much' trouble and expense. But you can say that the Brighton 'Beach Racing Association has not decided yet whether there will be a meeting tills year or not. It is simply a question of policy. We haven't made, a definite application , to the Jockej". Club-for fall dates, but the other track owners have been" informed that Brighton has not been wiped off the racing map and that under certain circumstances a meeting at the Beach can be easily arranged. "There's just another thing that cuts a figure. The Brighton Beach Racing Association is in better financial shape now than it was a year ago. Of the $35,000 owed to the horsemen at-the end of last summer's meeting, the greater part has been paid and tlie entire debt will soon lie wiped out. There was never a thought of not making good all obligations to the horsemen who won purses at Brighton. Other good work has been done since last year, and it begins to look better for the old track every day. But. as I said before, nothing has been positively decided." Tne race track owners have, been discussing dates for the fail meetings for a week past. From what lias been learned a harmonious policy will prevail, and if Brighton really wants to race, the once popular track will receive an allotment. But all obligations to tlie horsemen' must be made, good first. "When tho season closed last fall." said a prominent race track owner. "Mr. Engeman doubtless believed that there would be no more racing, so he proceeded to dismantle his track at Brighton, with the idea of cutting the property into building lots. Then came several court decisions which have given a new lease of life to the racing game, anrt as the sport is going along smoothly now with most encouraging prospects for the future. Mr. Engeman probably feels that it is a mistake to withdraw Brighton from tlie circuit. In years gone by Brighton Beach was a big money-maker. Which Mr. Engeman has not forgotten." It is said that the schedule of fall dates will be announced shortly and that, if necessary, the season will be extended to November 15, the last legal day of racing in the State of New Y'ork. The three yearlings August Belmout lias decided to ship to England to race next season under the management of trainer Watson are colts by Rock Sand, out of Beldame. Tea's Over and Orienta. Beldame is the Octagon Bella-Donna mare which won the Suburban Handicap of 1905. Her colt by Rock-Sand Is her -second foal. Her first was by Meddler. The Rock Sand Tea's Over colt is a hair-brother to the ramous King Eric horses. Ort Wells and Dick Welles. The Rock Sand Orienta colt is a hair-brother to Okenite and Ole-roso. The three youngsters Mr. Belmont will race abroad aro the best lookers among his yearlings, and they are all in the Epsom Derby or 1911. Mr. Belmont sent the favorite for the Derby of 190S to the post In the Nurserv Stud-bred Octagon colt. Norman III. lie is exceedingly ambitious to win that race with a home-bred horse. The yearlings Thomas Welsh will train for Mr. Belmont number twenty, and they are a carefully selected lot. Welsh has concluded Ills arrangement with the chairman of the Jockey CI nl) and will break the Nursery yearlings at Saratoga. It is IKisslble that he may sell a few after he breaks them. Welsh's arrangement with Mr. Belmont will not make It necessary for him to alandon the Newcastle Stable horses. He will keep the Newcastle horses and perhaps take over some others. The Newcastle Stable, which is now owned by Mr. Welsh, Andrew Miller and Francis C. Bishop, will race half a dozen or more two-year-olds next season. These youngsters were bred at the Mill-stream Stud, and most of them are by the French stallion, Adam, now standing in Hungary. Race Track Betting Not Sinful: Catholic Clergyman of British Columbia Gives Clear Headed Decision RACE TRACK BETTING NOT SINFUL. Catholic Clergyman of British Columbia Gives Clear-Hcadcd Decision on Subject. Victoria. B. C. July 2. Race" track betting, which is meeting with opposition by local protestant, clergymen, has gained unexpected support from Roman Catholic authority. It lias been pronounced neither sinrul nor objectionable In itself by the Rev. Father O'Reillv. speaking for the Jesuit Society. Whether or not attendance at the races and patronage of the betting ring were regarded with disfavor by the Catholic as well as Protestant churches has been actively debated during ten days past. The matter was finally referred for a decision to the Jesuit Fathers, and after consideration of all the Issues Involved. Father O'Reilly handed down his answer. "Horse racing is not a sin." says the opinion, "nor is attendance at horse races. You may all go, to the races who like and enjoy them as Innocent relaxations and interesting sport. Nor Is betting upon a horse race, or betting generally, a sin in itself. Betting Is quite unobjectionable if a man risks only his own money which he does not especially require. There are many cranks in this world who see harm In everything. If you have $5 which you do not especially require there is no harm In your wagering that money against another man's $5 on a horse to see which will win. This form of amusement is not sinful. "Servant girls, however, stenographers and those in receipt of only small salaries should not bet. And betting may become a sin under certain circumstances. There are many contingent circumstances to be taken into account, if a man risks the wages needed for the support of his wife and family. It is wrong. And if you have the money with which to bet. there may be danger of acquiring a passion for gambling, the same as by going to a saloon there is danger of acquiring a passion for drink. If you think you are in danger of doing this it is wrong to bet. "Betting once in a while is not a sin. It is when risking money which belongs 'to the family or any ono else that It Is wrong. All depends upon what a man bets and where he gets his money. God never intended anyone Hot to enjoy innocent amusement." Telegraphic Form TELEGRAPHIC FORM. Text of the Boasberg Decision TEXT OF THE B0ASBERG DECISION. New Orleans, La.. July 2. Here is the text of the decision handed down by the Supreme Court of Louisiana in quashing the indictment in the case or .Mark ISoasberg. who had been Illegally convicted of violation of the Locke law: '"Hie question presented is simply whether the district attorney may recuse himself on any ground other than one of these prescribed by said act 35 or 1S77, herein alMive quoted. We do not think that lie can. The grounds or recusation prescribed for judges in the said act have been held to be limitative, and we think that on the same principle the similar grounds prescribed for district attorneys are in like manner limitative. "The recusation of the district attorney In this case not having been founded on any one of the grounds thus prescribed, was null and void. The district attorney was. therefore, not recused: and since he was not recused nor sick nor absent, the judge was without authority, under act 74 of 1S80. to appoint an attorney to act in his place, and, in consequence, the appointment of Mr. Adams was a nullity and the information tiled by him -was a nullity." Arter discussing that clause in the bill or rights which provides that "prosecutions shall be by indictment or information." the court said that this provision is Intended to secure the citizen against prosecution by private citizen, by governor, or judge or any authority other than a grand jury or a district attorney. "To the grand jury and to the district attorney, and not to popular clamor or to the executive. Is confided by the constitution the discretion of determining when the citizen shall Ik? brought before the court. That discretion the district attorney must. uiKm occasion, exercise and not divest himself of, as he would his coat. And the very time when the iNilicy of our" law, as embodied' in the constitution and the .statutes, 'requires that lie should not shirk this resiKinsibility. is when there is popular clamor, or if judge or executive should ever undertake to dictate in matters of criminal prosecution." The court said that it was glad that it did not have to pass uixm the question of whether the system of lietting employed was violative of the Locke law. Tickets for the royal enclosure at Ascot are eagerly, sought after and for weeks before Ascot opens the lord chamberlain has a hard time of it refusing the thousands who think or pretend to think they have a right to them. This year the line was drawn more stringently than ever. Ascot is the. royal meeting "and racing is the king's favorite sport. There are many public functions at which he Is the central figure. He knows it anil likes it. but he goes racing to see and not to be seen. Last year there were too many beautifully dressed ladies who turned their liacks to the race course and kept their glasses fixed immovably uion the royal Ihjx. These are to be eliminated as far as possible in the future. Royal Ascot lias an original right to its title, the meet having been founded by a royal duke, "Butcher Cumberland." Though .the first issue of the Racing Calendar, dated 1727." records certain events at Asi)t. it was not till 1825 that the state procession was Instituted. From that time on It has been Ascot's distinctive feature. To be asked to be one of the royal house party at Windsor for the week is. of course, the great thing, but that is only for a very few. Tickets for the lawn of the royal enclosure are probably the most coveted tickets for any social function of the season. This year there were 2,000 more applications than in 1908. The royal procession consists of eight carriages, each drawn by four horses, containing the king and queen and their guests, and two pair horsed carriages carrying the ladies in waiting. The four-horsed carriages are large Open vehicles known as Windsor landaus. Postilions; .equerries and outriders all wear the royal scarlet livery. The spectacle is one of the prettiest pieces of pageantry to be seen in London, and given fine weather is enough in itself to draw the town quite irrespective of the racing.
