Harleythorpe carried Grasmere along at such a terrific pace the first half mile that the latter began running amuck at the bend, lirst colliding violently with the leader and then darting over to the outside and impeding his stable companion. At the most critical moment of the nice a disastrous collision between the pair was averted by Butwell's warning shout to Scoville. who pulled off and straightened out his mount just in time. Candieborry. which had licen taken off the ears onlv a couple of hours before the rich race was scheduled to be decided, ran phenomenally well. From a slow beginning witli an inside position, he was possibly more seriously affected by the crowding at the start than, any other contestant and during the early miming was next to last, securely pocketed behind n solid wall of horses. It was not until the homestretch was reached that the Wilson colt found an opening and his closing sprint was of the electrifying kind. The Canadian representative. The General Armstrong, also developed a Imlated and remarkable burst of speed and Hashed towards the front so rapidly in the last furlong that it attracted the attention of thousands of spectators. A tremendous amount of money was bet on the Keene pair at odds-on. Both liad shown such phenomenally fast trials just before the big race that the public virtually ignored the remaining eleven Mnrters, including the much advertised Candleborry and Barleythorpe. Keene said after the race that he was satisfied that he had a good horse in Sweep, notwithstanding that he lacked size. By winning the Futurity. James R. Keene becomes the leading winning owner on the New York tracks. S. C. Hildreth, who is still at the head of the American owners' list for IPO!), has heretofore led Mr. Keene ou the eastern tracks, but the outcome of the Fiituritv relegates him to second place, so far as the east is concerned. The Keene horses have now won $l(Hi.SI8 this season, while Ilildreth's winnings on the New York tracks total $81,022. First moiiev in the Futurity amounted to $2-1.100, and Mr. Keene received $2,000 additional as the nominator of the winner and $500 for having nominated the third horse. Grasmere's share of the purse amounted to $1,835. Overnight nominations for today's card were light. The adding of .lack Atkin. Hose (Jueen and Arondack materiallv enhanced the importance and interest of the Fall Handicap, at six and a half furlongs. The race, developed a brilliant contest between the top-notchers in the sprinting division. Besom, fresh from a series of successes at Saratoga, proved the dominant factor in the race. The l!en I'.rush gelding could have taken the lead away from Rose Queen at will, but Grand patiently abided his time and mnde his linal stretch bid more effective and certain, lie Mund was a greatly improved horse and finished a half length in front of the overburdened and Inadequately ridden Jack Atkin. Barney Schreiber's horse ran a wonderful race under the circumstances and the disappointed owner remarked to jockey Nicol afterwards: "You are getting too old for the game. Just as I am." Tlie long-looked-for announcement of the Latouia Jockey Club's intention to hold a fall meeting assures the horsemen of six weeks' racing in Kentucky, and this will bring manv a stable back west that expected Jo ship south after the Canadian circuit closed. "Bather significant was the statement that the meeting would not be held under the sanction of the Racing Commission," says the Enquirer. "This makes it appear as if a decision from tlie Court of Appeals will not le handed down until such time that it will not operate against the coming meeting, or perhaps a decision favorable to the La tenia Jockev Club is anticipated. Since then some capital racers have carried off its Lienors, Carroll, Gloaming, Illume, Ben Holladay, Imp. Water Cure, Articulate. Nealon and Beacon Light being conspicuous examples of the high-class borses which have contested the Turf Stakes. Thus, for the lirst time since its first running in 1890, the Partridge Stakes is a purse race. Program books of the Woodbine autumn meeting have been issued. The amount of added money to be distributed in an excellent list of events to he run during the seven-days meeting between September IS ami 25, Is $30,300. Forty-four races are given, with 110 purse of less value than 500. Of this number 28 races are at a distance of a mile and upwards, the Durham Cup being a mile and three-quarters, and the Ontario Jockey Club Cup at two miles and a quarter. In addition there are eight steeplechases down for decision, so there is every reason to anticipate a week of really good sport. Sea Sick II. More a Winner SEA SICK II. ONCE MORE A WINNER. Davld'.s Caroubier, Kovelia up, third. Developments at Henderson DEVELOPMENTS AT HENDERSON. Henderson. Ky.. August 30. William Rabb. Judge E. II. Caullield and Racing Secretary Sidney Courtln, charged with operating- the race meeting of tlie Albuquerque Fair and Racing Association without license from the State Racing Commission, were in court Saturday and, through their attorneys, demurred to the warrant, alleging that it was defective. Tlie court heard argument on both sides and will hand down his decision in a day or two. A warrant has been issued for the arrest of J. G. Bussey. president and general manager of tlie Albuquerque Fair and Racing Association, charging him with embezzling .$700 of the association's fund. He has not been apprehended. Mr. Higginson Changes Trainers MR. HIGGINSON CHANGES TRAINERS. Saratoga. N. Y.. August 30. In future Sir Wooster and Ballaealla, recently purchased by A. II. Higginson of Boston, who races under the nom de course of Mr. Chetland. will be trained by G. R. Tompkins. They will lie taken to Canada at once in charge of W. F. Presgrave to fill some engagements at Montreal and Toronto, and Mr. Tompkins will make frequent visits there to look after details. After that the horses will be shipped to Belmont Park to race in the steeplechases at that meeting. Equals American Record: Grania Runs Mile and Seventy Yards in 1:42 2-5 at Fort Erie 1 , EQUALS AMERICAN RECORD GRANIA RUNS MILE AND SEVENTY YARDS IN 1:42 2-5 AT FORT ERIE. Feat Was Accomplished in Winning Handicap in Which Prince Ahmed and Zipango, Bedwell Entry, Made Disappointing Showing. j Buffalo. N. Y.. August 30. Fast and spirited racing was again tlie order at Fore Erie this afternoon. Some of the finishes furnished keen excitement, the winner remaining in doubt until the official placing was displayed. The cool weather which prevailed did not deter a big crowd from attending. The feature race, a handicap at a mile and seventy yards, went to Omnia, but to beat Palaiuou she had to equal the American record of 1:42 for the distance, made by King's Daughter, carrying 124 pounds, August 25. 1908. Tlie disappointment of the race was the showing made by H. O. Bedwell's pair. Prince Ahmed and Zipango. They were short-priced favorites and were looked upon as having the race at their mercy. Prince Ahmed flattered his backers during the first three-quarters by running in a forward position, but when everyone expected him to pass into the lead and draw away he tired perceptibly and All Red was able to beat him for third money. Class Leader scored an easy victory in the steeple-, chase over tlie short course. He was much the best, led by a wide margin for the entire trip and won cantering. J. C. Ferriss and his connections pulled off a brace of coups in the first two races, liolh for two-year-olds, with Countless and Delf. The former Is owned by John G. Greener, who recently sold Olam-bala. lie was backed from a high price of 15 to 1 to 5 to 1, and won commandingly. Delf showed much speed for a half mile, then appeared beaten by Inflection, but when the latter ran out in the stretch got up to win by a narrow margin. Tlie last three races resulted in nose finishes and aroused the enthusiasm of tlie spectators to a keen pitch. Ben Double overcame interference in the fifth and. after a rough trip, finished witli great courage to down St. Jeanne in the last stride. Al Muller threatened to make a runaway race of the sixth, but gradually faded away In the stretch and succumbed to Casque in the last stride. Cruche d'Or and Golcouda had a spirited struggle In the sev- enth and the Seagram filly just managed to land the purse. H. G. Bedwell has disposed of Joe Rose and George W. Lebolt to J. W. Schorr. ----- Jockey J. Howard was fined $25 by the starter for disobedience at the post. Juarez Plant is Assuming Shape: Keen Interest in Opening of New Track Manifested in Texas and Maxico -Stalls in Demand JUAREZ PLANT IS ASSUMING SHAPE. Keen Interest in Opening of New Track Manifested in Texas and Mexico Stalls in Demand, EI Paso, Tex., August 30. After having been on the ground three weeks. Colonel Matt J. Winn declares that the construction work in connection with the new race track at Juarez, Mexico, is moving along more rapidly than he had expected. So far no serious snags have been struck, and It looks like plain sailing throughout. "The astonishing feature to me," says Colonel Winn, "is the number of applications for stable room coming from Mexico and Texas. I hadn't. an idea there were so riiany horses hereabouts, and the Interest taken here is amazing." Tlie twelve stakes which will close about October 1 will be supplemented by others to close during tlie meeting, these being arranged especially to suit conditions then existing. Both the Adams and the American Express companies have given the management a schedule of rates covering the shipment of horses both from New York and tlie middle west. The charge by the Adams from Jersey City to El Paso has been fixed at $075 for a car of twelve horses. The American rate from New York to El Paso is $S25 for a car of sixteen horses. The rate from Cincinnati will be about $150 less per car, and from Chicago about $250 less. Among prominent horsemen who already have applied for stable room are T. C. McDowell, S. C. Hildreth. Gossip from Fort Erie Track GOSSIP FROM FORT ERIE TRACK. Buffalo, N. Y August 30. The fall meeting which began at Fort Erie on "Thursday last is characterized by the same success that marked the summer session. It is safe to say that when the nine days of racing ends here it will be the most profitable that the Niagara Jockey Club iias enjoyed during a similar period. During this week there will be many shipments to Montreal, where racing begins on Saturday next. It has always been a mystery why the date framers of the Canadian Racing Associations should have permitted Blue Bonnets and Fort Erie to clash, even for one day. and allowed a lapse of three days to Intervene between the close of Windsor and the opening at Fort Erie. A feature of the racing on the Canadian circuit is the excellent work of starter Dade. Since his discontinuance of the absolute llatfooted style he has been doing perfect work and has eliminated the delays that characterized his former efforts. It seldom happens now that lie keeps the fields at the IKist over two minutes, and in most instances thev are sent away Immediately on reaching the barrier. Mr. Dade will leave here for Montreal on Friday next to dispatch the field at Blue Bonnets on opening day. Ed Tribe will remain here to send the horses away on Saturday. The Buffalo police do not know John Travers. Edward Kelly and John Connors, arrested Saturday on a charge of wire-tapping. The tracing of the tappers and their arrest .was the result of weeks of persistent work by Collins, tlie frontier operator. On August 10 last the telegraph company began to suspect that somebody was tampering with its leased wire from tlie track. This wire supplies the entries, race results and other information from the track to poolrooms in Cincinnati, Toledo, Detroit. Cleveland, Albany and to a point just outside of New York. ' Sari Francisco, Cal., August 30. In presenting Arguments before the District Court of Appeals re-ix-ntly in support" of an application for a writ of habeas corpus in the case of Frank O'Sliea, accused pf having violated the anti-betting law at the Ingle-slde Coursing Park, attorneys Carroll Cook and Henry Ach attacked the validity of the enactment of the recent legislature, commonly known as the Walker-Otis law. O'Shea was arrested on a warrant based on a violation of the penal code. Through his attorneys be made three distinct contentions in his attack uptin the validity of the anti-betting law. OlShea's first contention is that by reason of the complex form of the section of the code the section being one complex sentence of 'over' thirty lines it is unintelligible, and of such phraseology as to make it Impossible to determine what particular acts are necessary to be grouped together to constitute the crime intended by the section to be denounced. His second contention is that the provision, when read itt connection with other provisions of the chapter of the code in which it is found, are so unreasonable as to be void. His third contention is that the penalty affixed to the section of the code Is absolutely void. Uin this last contention his attorneys based the greater part- of their arguments. They argued that the penalty allixed by the legislature attempts to confer upon the courts .functions that are not judicial mid legislative powers that cannot be conferred upon the courts. In case of conviction, according to the attorneys, the statute thdt is being attacked gives the Judge the power to fix the penalty at Imprisonment in the county jail, making it a misdemeanor. Or in the state prison, making it a felony, if the court so desires. , Judge Cook cited the imaginary case of two partners engaged in business. Neither attended to the actual transaction of the details, but employed a clerk or agent. This clerk or agent permitted alleged violations of the law to be carried on, and the two partners were arrested. One, if convicted, is sentenced by the judge to a term in the county jail, branding him merely as a culprit. The other, however, if the judge .so desires, is sentenced to a term in the penitentiary, making him a felon, although both are guilty of the same offense. .Arguments in opposition to the defendant's con teiitlons were submitted by representatives of the attorney-general and district attorney's oliice. At the conclusion of the arguments both sides were ordered by the court to submit briefs, the prosecution being granted five days in which to prepare ils case and the attorneys for O'Shea being granted ten days in which to answer. Prospects for Toronto Meeting PROSPECTS FOR TORONTO MEETING. Buffalo. N. Y,, August 30. W. P. Fraser. secretary of the Ontario Jockey Club, was a visitor at Fort Erie this afternoon. Mr. Fraser brings glowing accounts of the prospects for the meeting which will be held at Woodbine this fall. The Ontario Jockey Club has been extremely liberal to the horsemen and every effort will be made to provide high-class, sport during the seven days' meeting which will iK'gin September 18 and continue to and including Septemlcr 25. There will bo eleven stakes and $30,300 will be added to the purses by the club, with $500 as the smallest purse- The overnight handicap's1, will range In valne from $000 upward; There will also be a steeplechase every day. to which SS00 will be added, and as an incentive to the riders tlwi club will add SCO to the jumping races to be divided among the successful jockeys. Powers Probably down Long Time POWERS PROBABLY DOWN FOR LONG TIME. New York, August 30. When the Jockey Club stewards inflict an "indefinite suspension" It usually means banishment for a long time. For that reason It is believed that jockey Powers will not be seen in the saddle again this year, if ever again. William Kuapp. a well-known jockey, was set down in a similar manner by the Jockey Club more than two years ago. and has never been able to have his " case reopened. No specific charges against him were made public, and the same thing has happened in other instances. Benning Track to be Abandoned BENNING TRACK TO BE ABANDONED. Baltimore. Mrt.. August 30. President Samiiel Boss of the Washington Jockey Club says that the Idea of holding any fall meeting at Denning has been abandoned, and that as far as lie knows neither the Washington Hunt Club nor any other racing association in the District will conduct a meeting. President Ros's' statement has revived the rumor that the large tract of land now under lease to the Washington Jockev flub will be disiiosed of and within a year will Ikj cut up Into building lots. "There is a confident' feeling among local followers of the turf that there will be racing here this coining winter. Despite the delay of an ollicial announcement everything points to the fact that a meeting will be held under the system that prevails1 around New York this summer. The proposition is to keep the sport alive, even if it costs the association twenty or fifty thousand dollars," says the Chronicle. "It is not unlikely that the purses will be trimmed to some extent, although the stake events will be retained, in all probability. As the meeting will be somewhat in the nature of an experiment, the lumber of- days will be materially reduced from previous seasons. This change will be welcomed by all who have the best Interest of the sport at heart and would have a tendency to placate many people who have heretofore opposed racing. The California Jockey Club may be expected to give out some definite information in the near future." Salt Lake Track Nearly Finished SALT LAKE TRACK NEARLY FINISHED. ,;t t- Salt Lake City. Utah. August 30. According to General Manager Finn, the new mile track of the Utah Jockey Club at Buena Vista Park Is all but ready to be turned Over by the contractors. Success of Saratoga Meeting Leads to That Conclusion Officials Tell of Results. Saratoga. N. Y.. August 30. With the 1009 meeting of the Saratoga Association a matter of history, the feeling prevails that the critical point in racing as a sport in New York state has been passed. "The Saratoga Association lias been successful beyond our highest expectations," said President Wilson. "1 think the races here this- year have drawn the highest class crowds that have ever assembled at a race track. The professionals have been almost unnoticed In the crowds of men and women whose only interest in racing is as a sport, and. taken as a sport, they have found it so pleasing that they have come daj- after day, content to watch the struggle without a dollar invested on the result. Not alone from New York City, hut from the west and south we have had visitors who have hitherto had no acquaintance with a race track. We began this meeting with foreboding; we end it in mutual congratulations." 'Trom a financial standpoint tho meeting has been far above what we expected." said Andrew Miller, treasurer of the association. "We were fully prepared to face a deficit, but instead we are certain that there will be a profit on the meeting itself that may pas' all the year's expenses of the association." "The attendance this season was. by actual count, fully 50 per cent, ahead of last year," was the report or Assistant Secretary Earlocker. "On some days we even exceeded the gate count of three years ago. under the old laws." "The crowd was unusually large for the final day. Excursion trains and trolleys from a dozen cities within a radius of a hundred miles came In nil morning loaded with passengers, who were taking their last day at the races until next year." William Easton, for many years the leading auctioneer of thoroughbreds in this country, is living in a small town adjoining Dublin, in Ireland, and is far from being a well man: in fact, he is so low that his recovery is despaired of. Phil Chinn has not decided what disposition ti. make of his racing stable this fall. Mr. Chinn has some useful campaigners, but lie has been having ill success of late. His horses are at Saratoga and he is undecided whether to ship to Canada or continue on the New York tracks. William Mahoney, who pleads that within the last live years Ed Alvey has outgambled him to the total amount of SS.473. has filed suit at Louisville against the turfman for recovery of that amount. He does not sue under the law which allows the recovery of three times the amount lost. A yearling colt which has attracted considerable attention at Saratoga from experienced horsemen is one bred bv William L.- Powers. The youngster is by Ort Wells out of Adeek. He is a 'chestnut of line size and substance and possesses the stamp of a real race horse. Mr. Powers has named him Compliment. Martin Nathanson has returned to Chicago from Butte and Anaconda, where he served as presiding judge and racing secretary. He will return to Montana to serve In a similar capacity during two weeks of racing at Helena, the first week of which will Ims in connection with the State Fair, which opens September 22. At the close of the Helena meeting he will again return to Chicago.
