ratified it and made it for themselves and their posterity iho supreme law of the land Applause It is I think safn to assert that in no other part of the vorld could such a- fundamental change have been so peaceably made at that time and perhaps it is equally safe to say that it cruld not have been mude here twenty or thirty years later Why and how this union was formed are historical questions which it would he superfluous and in fact impossible to ditcuxs upon this occasion What benefits what advantages it has yielded or conferred upon us how its bonds shall bo strengthened and tho pros Â¬ perity of all its parts increaied and perpetuated are questions which challenge our uttenlion constantly Ihe old confederation possessed no meats of sustaining itself Iu fuct it was It had no hut a fcLcleton of a government power to impose taxes cr to regulate comIt had but merce or to administer justice one of the essential departments of a real oven the legislatureand government that was defective and almost impotent Each state bad the right to lay imports and duties subject only to the condition that lhey should not interfere with treaties entered into by the United States in congresk assembled with foreign kings princes or There was no limitation whatever states upon the power of any state to Impose duties upon the products of any other American state brought within its limits for sale For the purpose of raisor consumption ing a reenue or for the purpose of encouraging its own domestic manufactures the stata of New York had full power to Imposo any rate of duty it might see fit to ettab lieh upon the products of New Jersey aud tho state of Now Jersey possessed the tamo power in respect to the products of Now York If the doctrine of protection is what its friends claim if its application to infant industries in new states cuablcs them to overconio natural disadvantages and to secure a higher degrco of prosperity than would otherwiso be attainable it must be admitted that tho arrangement existing under the confederation was a vise ono and Ap- Â¬ ought never to have been disturbed plause But gentlemen the framers of the constitution tho men who founded this federal union did not think so Applause They believed that freo trade absolute free trado between tho several states was imperatively demanded by tho interests of And accordingly lhey adopt tbo people ed ibis provision as a pnrt of the constltu lion without n single dossenting vote No state shall without ibo consent of concrcts lay any imposts or duties upon imports or oxports except what may ho ab solutely necessary for executing lis inspection laws and the net proceeds of all duties or imposts levied by any state ou imports or exports shall be for the us of the treasury under consideration that if the states have such different interests that they cannot be loft to regulate their own affairs without encountering the inter- Â¬ est of other states it is proof that they
