fot Appeals A The Court of Appeals last Wednesday passed on the famous election case taken from the Pow ell Circuit Court last December The election held in this city last fall for the selection of Police Judge Mayor and was held under the supervision of offi cers by Mayor Daniel and in the city court room instead of the regular voting place The certificate of the officers showing the result of the election was I placed in the ballot box when it should have been filed with the election commissioners The com missioners refused to open the ballot box and count the vote on the Citizens ticket brought against the officers to compel them to open the ballot boxand make the count Judge Benton decided the election ille gal and case was appealed The Court of Aopeals holds that when a voting ter ritory then there must be separ ate ballots In affirming Judge Benton the higher court says in part We are of the opinion that the section under which appel lants claim office was invalid The officers who were appointed by the election commissioners and who actually held the elec tion for members of the General Assembly and county offices were the only persons authorized to hold the election for munici pal oliices We cannot uphold the action of the parties who held the election at which appel lants were voted for upon the ground that they were de facto oflicers There can be node election day Nov 000- at the Christian Church THREE MEN KILLED Saturday by an Accident on the New Mountain Central Railway Returning from their work to spendSunday with their families Bud Smith engineer Charlie Lith brakeman on the Mountain Central railroad and Joe Derick son sawmill man were Saturday evening hurled to awful death by the engine getting out of con trol Mack McNab and Clint M train members of the train crew were internally injured The train was returning from Oampton heavily loaded with ties and as they started down a steep grade of a threemile stretch the brakes were applied and great precaution observed by Engineer Smith Soon the speed of the engine began to increase when it was learned that the brakes would nt work The speed rapidly quickened warning the crew that disaster was inev- Itable Every effort possible was put forth to check the trains speed but to no avail As the train came to a curve circling a round n cliff the engine left the track and jammed squarely up against the cliff throwing the victims to certain death Smith was brotherinlaw to both of the dead men Derick son and Smith each leaves a wife and one child and Lith leaves a a wife and two children Derickson is a son of James B Derickson of this city His remains were brought hero Sun day afternoon but were taken to Stanton Monday and buried in the beautiful cemetery there funeralservices Being conducted before burial by the Rev R A Irvin of this city Mr Derick son was an Odd Fellow and the burial was under = their direction Lith was a son of the Rev Litli a Methodt graveyard on Hardwicks Greek Tuesday Funeral servi ces at the grave by the Rev II A Irvin of this city Deceased was a daughter of Mr and Mrs John W McKin noy of Hurdwicks Greek and was thirtytwo years old She leaves a little girl two years old besides her husband She was a monitor of the Methodist church a devoted wife and loving mother and she numbered her friends by the number who knew her Mrs Ware was one of Powell countys leading school teachers having taught successfully for fifteen years and was on the board of examiners for several years Her death was a loss to the community in which
