what went on between them I do not claim that the course of the judge in sending out for bystanders when there was a number of jurors names left in the wheel was contrary to the statute law of Kentucky for in the winter of 1894 the jury law had been soI amended as to give to the judges the discretion of sending a talesmen even on the ttlal of felon cases but that a legislature regard less of the citizens right to life and liberty has vested in the judge the power of packing the jury whenever it suits his fancy does not alter th proposition that a trial before aJur- thus packed is in the classic words of Lord Denman a delusion a mockery and a snare The judge knew that the case before him was one arousing the strongest political feel- Ings nnd that the Sberlfl of Scott county was a rank partisan who tbeomI would abuse his trust in the way in which he did Tnere is a queer and near coincU dence between the 59 omitted names the OConnell case and the 63 names left in the wheel at George townCaleb Powers had against him only- a paitisan judge and a packed jury but the attractions of the one huddred thousand dollar rewaid for perjured witnesses which a partisan legislature hsd placed in the bands of a rabidly paitisan board and moreover the wealth ol the decemlcnr a bachelor which fell to his brothers and which they lavished without stint in the employment cf counsel among these Thos C Campbell formerly of Cin cinnati now ot New York lamed as the most unscrupulous criminal law ycr rf the United States Pour men testified against him who professed o have been in thorough sympathy with the alleged conspiracy against Goebrls lift two of these are named as accomplices In the indictment yetI none of them was willing to that he bad a rational motive for turnting against his friend such as immunity which Is usually promisedt to accomplices who turn dence They must have lied In deny ing any rational motive for their treachety Under the law their test mony was insufficient unless corobo rated from other sources and each ol o them was amply contradicted or im eacheci by men of infinitely higher standingcThe indictment charges that one ot ve named men or some other perI on to the jurors unknown killed Goebel and that Powers who was outII 1 town at the time of the deed Tay or and five others conspired among themselves and with the five first mentioned and among leading Re publicans for removing this man bytthe assassins bullet for his could not benefit them but would only confirm the Legislature and tbet sell constituted Election Board in their unholy purpose of unseating the offi cials by the people What then was w the motive which led the packed grand ury at Frankfort the packed petty ury at Georgetown and the politic ins who stood behind them to robbers an object ot the keenest bate and there was also a political necessi The men who had cheated Taylor Powers out of their offices and ho had upset free government in Kentucky needed the cry ot assassi nation to offset the cry for civil liber of their opponents Caleb Powers Charles Flnley his redecessor In office and Governor aylor probably did a very foolish when on the 2511 of January 930 they brought more than one- housand armed mountaineers toc etition the Legislature for juitic In he contest matter It looked very uch like an attempt to terrorize and intimidate More than half of the tes timony for the Commonwealth related o the part which Caleb Powers bore n bringing the mottntainteers toI Frankfort but on the same day on which they came all but one hundred fifty went back to their homes Judge Cantrill instructed tbe jury tbat- In the prisoner had conspired with any Ilf the persons named in the indict or with anybody else for th of TERROR or INTIMIDATION and one of his the proceed ings of the Legislature were lawful He herein alleged that the contest boards were fraudulently chosen thai the contest boards were not selected by lot as provided by law but by a
