at Beaver Dam about two weeks aln We find upon investigation that Jarnagln returned home at 8 or 9 oclock p m on Sunday night and went to his family room Finding his Jamlly not there he knew they were In the next room usually occu pied by Miss Taylor as they always occupied the tame room in his ab sence Finding the door lockedhe called to his wile and no one respond ing he knocked louder on the door which frightened theiwoman intense ly Miss Taylor jumped from a win dow ran across the street and told the hotel keeper Mr Anstln that some one was killing them butnot mentioning Jarnaglns name Mr Austin returned with her to the seal dente where quiet had been restored and Jarnagin had retired not know- Ing that Miss Taylor had lelt the room At Jarnaglns request a thor ough investigation by While the charge oi conspiracy to rob the Rx pressCompany lodged agalnstSchleltz baum is a misdemeanor punish able by fine and Imprisonment only yet on accent of the great amount Involved in the alleged conspiracy and the Important bearing of the result ol this trial on the result of the civil case of J W Boatner against the American Express Company to recover 28000 which he sass the com pany had undertaken to transmit tom him from Otvensboro to Fordsvllle of which Sleltzbaura as express agent at Fordsvllle claims to have been robbedThe circumstances out of which this proseantlon grew occurred on the ijth of August last when J H Boat ncr expressed a package said to con tain 28000 from OwensborotoFords vllle and of which Schleltzbaum as the American Express Companys agent at the latter place claims to have been robbed before it was called for by Uoatner When the case was called for trial the Commonwealth was ready with an array of witnesses chiefly American Express Company employes from Owcnsboro Louisville Chicago and other points J W Schunlacher Superintendent Pinkertons National Detective Agency of Chicago appear ed also for the Commonwealth- The trial Schleltzbaum had more the appearance of a prosecution by a the American Express Company than by the Commonwealth The great crowd of spectators who sat patiently in the court room throughout the long drawnout trial took the keen est Interest In the proceedings Notwithstanding the large number of creditable witnesses present for the Commonwealth the prosecution found it difficult to prove the alleged conspiracy Four days were consum ed in the examination of witnesses for the prosecution and the substance of the evidence was that J W Boit near had been seen in the company of A B Schleltzbaum at an isolated point on the I C railroad near Fords vllle on Sunday afternoon previous to the 15th of August on which the al leged conspiracy was charged to have been consummated That on Thurs day following J W Boatner presented himself at the Deanfield Ky express office and asked to express 28000 to Fordsville a station five miles south of DeanCeld and upon Information that the DeanGeld office could not handle sums of that amount went on the evening train to Owensboro and and from the American Express office ta that city sent the following morn lug a package said by the sender to contain 28000 to Fordsvllle That Boatner followed the expressed pack age to Fordsvllle on a late evening train the same day The evidence further showed that upon his arrival at Fordsvllle Boatner went to the Howard lintel anti engaged lodging for the night and that shortly alter his arrival at the hotel Schleitzbaura cal ed on him and that the two Boatner and Schleltzbaum left the hotel together and were gone about fifteen minutes after which Boatner returned to the hotel and remained there until the next morning Schleltzbaum was the first wittiest called for the defense He testified that he received the package In ques tion in apparent good condition and called on Boatner at the Howard house to try to Induce him to tAkeI charge of the valuable package which hr Schleltzbaum did not care to keep in his charge over night but that Boatner refused to re ceive the package and directed Schleitzbaum to reship the packageJ to him at Louisville said that about 8 oclock the same evening he started to the telephone office with the packpge In question In his possession as the rules of the Express Company required and thatI when In a dark alley on his way to answer the telephone call two mask ed men attacked him with drawn re volvers and compelled him to give up the package and accompany them up the Texas railroad toward Louisa ville for some distance they told him they must now make their escape and he must submit to take some knockoutdrops which would not hurt him except to render him unconscious for awhile after which he would revive without see rious effects from the drug Only a few
