the five days ot the special term were productive of more returns thin any session ever held here there were five murderers tried which was at the rate of one each day Tom Me Ghee was acquitted of the charge of murdering John Lear a boy Ben Rosson was convicted of the murder of lollie Fentress a negrcss at Central City and the jury gave him a sentence of thirteen years in the penitentiary Application will be made for a new trial and Rosson remains in jail Ike Cash a negro was given a life sentence for the murder of Earl Smith at Elk His case has been appealed and Cash was carried to Russell ville and lodged in jail Ed Kirk man and Wes Hinton were carried to the Eddyville prison last Satur day the former on a life sentence and the latter to serve five years Judge Sandidgc made a new re cord in the trials and there has never been in the state probably such a thing as five seperate mur derers tried in as many days were held at night but usually slid not last beyond 9 oclock Central City Election Held Void The election held in the First magisterial district and in the city of Central City Dec 7 1908 to take the sense of the voters as to whether whisky should be sold in said territory was last week made void by a decision handed down by the court of appeals The district voted against the sale by some 400 majority and the city went dry by majority Judge Sandidge of last real election a can be once when preliminary qualifications have been met It is understood that the prohibition ele ment of Central City is anxious to have another vote and that it will be called at once In reversing the judgments of the Muhlenberg Circuit Court in the case ot John T May against J B Ferguson the Court of Appeals null and void a local option election held December 7 1908 in Magisterial district No i of Muhl enberg county including Central City In this election the district went by a majority of about 400 and the city by 23 At two previous elections Central City had voted the last time October 6 1906Construing the Cammack County Unit act the court by Judge Las sing says that the law establishes the whole county as the unit except when it contains a city of the First Second Third and Fourth classes and as Central City is a Fourth class town the court says there are two units in Muhlenberg county the city and all the territory outside in the county so long as the city preserves ItS identity by taking a vote upon the same day that the vote is taken in the entire county its statutes cannot be changed by the will of the majority of voting population of Muhlenberg county much less of a Magisterial district therein and the precinct or Magis terial district in dry territory no longer being recognized as a unit there was no authority under which the County Judge could legally or der the election in Magisterial dis trict No i and as a vote had been taken in Central City within less than three years from December 7 1908 the Judge was without author ity to order
