must cause him to bang his bead in humiliation and shame Tho spectacle of a judge deliberately and unblnshingly prostituting his offlco to tho service of a notorious scoundrel in jeop-¬ ardy of tbeliw is a painful and shocking one under any form of government and Id any stage of civilization But It is more painful and more shockmR in this Repub ¬ lic perhaps than in any other country on the earth We print elsewhere a Very fuli history ol the conspiracy to save a notorious malefactor from punishment for his misdeeds which culminated yesterday in an infamous deliverance from the bench The name of this malefactor is William Wade Dudley and his crime wa3 the composition and circulation of a letter giving detaded instructions for the debauebmentof the electors of tho State of Iudiasa Tho publication of this damnable letter shocked the moral sense of the country and evoked a loud de mand for the summary punishment of the author The proof of authorship wa promptly supplied by the confession of the guilty man himself and when in due course the Federal grand jury for tho district of Indiana assembled in thii city hon est men everywhere looked to that body with confidence for such action and that speedily as the law and the facts warranted Fortunately the law was ample tc cover Dudleys ofleuse It made tho aiding abetting advising and counseling of bribery a felony and Judge Woods as in duty bound so instructed the grand Jury In ha charge he said among other things of like import Tht latter clause of the section makes any one guilty who counsels bribery This clause makes it an offense for any one to advise another to attempt to commit any of the offenses named among them is the buying of voles in this section so that while it is not a enmo to make the attempt it is a crime to advise another to make the attempt If A attempts to bribe D that is no offense under this statute but if A ad vises B to attempt to bribe C then tho one who commends or gives his advice is an offender under this law and I wiU say that there 13 some wisdom in thi3 provision The law cited under this construction as it is the only construction it is susceptible of if language has any meaning fits Dudleys case as exactly as if it had been made for it Judge Woods declared in conclude ing his charge that Ins instructions covered all the charges he had heard brought against anybody or that are likely to be brought against anybody and he added If you have heard as 1 hare charges pub lcy brought in our prints and elsewhere against any citizen of his having offended under these statutory laws we havo considered regulating an election it is jour duty to take cognizance of these charges brought against him investigate tbo evidence of guilt that stands against him and fearlessly renderyour indictment without regard to the political party to which he may belong or the official position he may hold or may have held whenbccommitledsuchoffense Under this charge all that was necessary for the grand jury to ascertain was that Dudley had written the manual for vote buyers and sent it to some person in In ¬ diana to make the return of au indictment against him obligatory An investigation was at once begun witnesses were sum moned from various parts of Indiana and from other States and the evidence of Dudleys guilt much of which is familiar While to the entire public was secured the investigation was in full tide Judge Woods suddenly sent the jury homo for a week ostensibly to enable him to hold a session of Ui3 court at Fort Wayne Tho session was held lasting only an hour and forty miuutes by tho watch but Dudley got the benefit of a weeks delay When tho investigation the jury reassembled was resumed and was continued until tho adjournment for the holiday recess Just before taking tho recess tho jury request- ¬ ed Judge Woods to instruct them as to whether it was necessary in order to in- ¬ dict a person for sending a letter advising bribery that tho name of tho porson to whom such letter was sent should be known Tho judge declined at the time to enlighten them upon that point but yester- ¬ day under tho pretense of answering tho inquiry he gave the jury supplemental instructions in direct conflict with his original instructions and of such a nature as to mako Dudleys indictment practically impossible In November he told thrm very plainly that advising an attempt to commit bribery was a crime yesterday he told them that advising an attempt to commit bribery was not a crime Without this supple mental instruction the jury was bound to indict Dudley and it came just in the nick of time to save that precious rascal It will be seen that Judgo Woods deliberately stultified himself that he ate his own words and put himself in an attitude which no judgo having any regard for tho dignity of bis office for the traditions and associa tions that cluster around the bench and for his oath to justly and honesUy administer the law would bo willing to occupy for a moment It i3 not necessary to enter into details as to the influences and motives that inspired this unprecedented and most scandalous abuse of judicial power They are patent to every body The inUmate personal and which William Wade political relations Dudley occupies to the President elect ol the United States ore generally known Judge Woods it may not be as generally known is also on intimate and confidential relations personally and politically with the President elect Dudleys crime placed a stain upon General Harrisons tiUo to the Presidential office His indictment would not only deepen that stain but it would probably involve revelations that would be most embarrassing to that gentleman and to many other conspicuous members of hii party Some time since Dudley served no tice that his pockets were filled with dyna mite which would bo exploded if he were Matthew Btanley Quay visited prosecuted Indianapolis in his interest a few weeks ga A E Batcman his business partnor was hero day before yesterday on a similar errand The strongest pressure social po liUcaland porsonal was exerted to save Dudley The newspaper organ of the camo to his defense All tho agencies that could bo enlisted in his be fcalf were set in motion As tho probability ot his indictment de- ¬ veloped into a practical certainty tho press ¬ ure was redoubled and finally all other expedients having failed Judge Woods was induced to call the jury before him and tell them that he had misstated the law to them and that they had no right to Indict Dudley unless certain things not susceptible of The SenUnel nroof could bo established is informed and believes that this action was taken after consultation witn ana upon the importunities of men as close to Benja min Harrison as his recent law partners Tho occasion is one that calls for the plainest of plain speaking It our bench fails us an honest and fearless public press must supply the deficiency so far as it is in its power Weighing our words carefully and fully prepared to accept all the consequences we pronounce the course of Judge Woods in this matter a monstrous ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ Tho tarifT of 0 72 a ton protects tho furnaces 0 tho North and of tho South Its benign influence creating wealth out of nothing giving employment to idle laborers at high wages and at tho same time furnishing the American consumer pig iron at lower rates than he can buy it for in En glandthis tariff wo say defies tho lavrs of gravitation and overthrows the muIUplb cation table alike in the North and in the South and yet whilo tho total product is less by seven per cent the increase from Southern furnaces is over fifteen per cent Why is this I What explains the great as tivity ht tho Southern furnacos at a time when low prices compel one out of thirteen furnaces in the North to shut down Tho answer is that the cost of producing Iron in tho Southern States is so much less than elsewhere that a price which is un remunerativc in one section leaves a mar gin of profit sufficient to justify the erection of moro furnaces In the Southern Htatcs Every year sees the cost line for pig iron tn the South sinking lower and lower For years money was squandered in the use of charcoal Then whoa coke was used furnaces wero built after the old plans which elsewhere had been replaced by better construction and better methods Tho very abundance of natural wealth with tho prevalence of high prices retarded the progress of the Southern States in thi economical production of pig iron Moro progress has been made during the era of low prices than during tho era ot high prices becauso economy was then the cost of salvation Still wo have delegations of Southern fur hard owners going to visit General Harrison promising him the kingdom of the world and the glories thereof provided ho will not consent to any reduction in the tax en pig iron Pig iron is tho basis of our whole mechanical structure In a new country with bouses and barns to build with great roads and bridges and cities to construct cheap pig iron pig Iron at the lowest possible cost is only second in importance to cheap food and cheap clothes Government science and philanthropy concern themselves or should about tho welfare of the many yet we have a demand in the name of all three for a tax on pig iron of nearly 100 percent in order that the badly located furnaces in Pennsylvania and Ohio may still remain m blast and tho furnace owners of the South may roll up their great dividends or remain unpunished for their bad management The tax of 672 a ton on such a raw ma- ¬ terial as pig iron is an outrage on civiliza- ¬ tion If an army should Invade our territory and injure bridges and towns and roads to the extent or M 000000 wo would speak of them as barbarians yet tho robber barons by exacUng a bounty of J673 per ton on pig iron do a much more grievous wrong to the people and we caU them pro-¬ tectionists Such a tax doth work like poison in the blood It enters says the Louisville Courier Journal every Industry and clogs every channel of commerce From the finest steel to tho hinges on the gate every article is dearer is more costly because of this pig iron tax It is a tax borno by the millions for the benefit ot tho millionaires The peopieare awakening to the enormity of such a tax and as the discussion goes on the tax of672onevery ton of pig iron will be made soraanifst that its advocates will bo sentenced to some asylum for the care of the incurably insane ¬ ¬ ¬ ¬ ¬ Congressman to the writer iri a conversation at the National capital a few days ago Nor does it take ono long who has given thoughtful attention to the situation at Washington to discern tho wisdom of tho remark That the Cleveland bark went to pieces on the tariff snag is now conceded by all and to none is It more ap- ¬ parent than to the retiring President him self Ho realized In the beginning tM danger involved in a campaign conducted on this single issue but with tho stoic heroism characteristic of the man preferred defeat la a fight for principle rather than a victory won by pressing a temporizing policy The incoming administration must like- ¬ wise be impressed with the menacing aspect of this tariff question forthero is more division in the Republican party on this sub ject than there ever was in thd Democratic party The Western States were held in line by the Republicans with tho promise of tariff reform on the Allison plan which differed but sligbUy from tho Mills bill It is already evident says the St Paul Globe that the Allison bill will not bo acceptablo to tho Eastern monopol sts and if the meas ¬ ure evor passes Congress it will havo been so changed as not only to bo unrecognizable by its framers but it will bo moro advanced in tbo direction of an excessivo tariff than the present law In many instances the duties will be raised in but few will they be lowered and thoso on articles of but lit tle importance while many articles how on1 the free list will bo added to the list of pnJ tccted articles The result of such legisla- ¬ tion will be to create intense dissatisfaction among the Western people and four years hence the question of tariff reform will be agitated in a way that will bo dis couraging to Republican prospects The wisest Republican leaders fully realize the dangers which environ the party becauso of the probable mistakes that will be mado on this question With tho party management in the hands of the Quay and Blaine crowd they seethe utter hopelessness of securing a reduction of taxation during the Harrison Administration Unless the promise of tariff reform made dur ¬ ing tho canvass is fulfilled they are con- ¬ scious that they can not win the confidence of the masses with their promises in the next Presidential contest If tho tariff could be entirely eliminated from NaUonal affairs the Republicans would be as happy as clams in high tide But it can not be Nor will it ever bo until it is setUed and settled right ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ Be10 Allison of Iowa regarded as a clean handed headed it levellTnnPTp member ¬ land and his services Colonel Lamont hastily wrote a litUo sketch of tho candidates career threw in some of his public addresses and sent it to the printer When ho was revising the proofs his attention was called to the fact that he had not prepared a title for tho pamphlet and he wrote one that was descriptive of tho contents This was too long togoiatooncline across the top of tho title page and the printer urged the Colonel to give him a short and catchy heading Colonel Lamont has had some experience writing bead lines for the Albany Argus and he promptly wrote Public Office is a Public Trust Immediately under this heading was a portrait of Grover Cleveland Thus hastily christened the first campaign biography of Mr Cleveland was given to the public Wherever it went it carried the picture of the Presidential candidate under the lofty and sonorous sentence Public office is a public trust and everybody supposed the title was a quotation from some official communication of the original of the portrait But it was not it was invented or remembered by Daniel Lamont at the behest of an impatient boss printer ¬ ¬ VERY NEAR THE TRUTH The Origin of a Quotation Familiar for Four Yean Tho Chicago less than one of ability and sound statesmanship Senator Allison is now quoted as saying Of courne I do not know that Iowa is to have a place in the Cabinet But it she does I have suggested Mr Clarkson for that place His services in the campaign entitle him to important recognition This is the same James S Clarkson says tho Chicago News who staads charged with having received as vice president of the Hephblicart National Committee sundry stolen property knowing tho same to be stolen and thereby rendering himself liable to a term in Sing Sing under the New York penal code It is the same Clarkson who boasted unblushingly of his attempt to bribe Governor St John with 25003 to abandon his party in 1SS4 and who in the event of Mr Blaines election was to havo been rewarded with the should not ignore this precedent Ho would be more discreet if ho waited until it be seen whether Mr Clarkson is to wear stripes for his services in tho campaign Surely neither the State of Iowa nor the Republican party is so barren of creditable material for Cabinet officers that the President elect must be forced to official association with tho men who do the dirty work bf the party They Want a Scaprgoat Certain Democrats in New York are just now showing their lack of wisdom by abus ing President Cleveland for getting him- ¬ self defeated This is really very rich considering the sourco from which it comes New York defeated President Cleveland and at the same time elected a Democratic Governor whose official record is notoriously bad This being the case says the Chi- ¬ cago News tho Presidents failure becomes a certificate of good moral character of which he has a right to bo proud The Democratic iarty a3 led by President Cleveland in the late campaign was a better party an
