well process has furnished more litigation for the United States courts than any other man in the country obtained to day a rule in the Supreme Courtthe form of which is probably unique In 1897 Green obtained judgement agnln t e city of Lynn Mass fur 11500 for- 1rigemtnt of his driven well patent Not being tutisQud he appealed to the Circuit Court of Appeals for the First Circuit The appeal was granted by Judge Putnam Mho indorsed the ap peal with the statement that he was afraid it hail notbeen perfected in time e App Hate Judge threw out the ap peal on the ground suggested by Judge tinun From this judgment they to allow Green to appeal to the Supreme Court- Thereupon Mr Green lastM anday by his attorney presented a petition asking leave to file a motion for a writ of mandamus to these
