that I helievfld that the manner III which our turnpikes were worked by tho Fiscal Court was illegal and altogether wrong I contended that Judge Tnrpin as the presiding judge of that Court was re peopleIwith the statement that it was only my opinion that it was illegal and wrong and possibly I might be mistaken For the benefit of all concerned I here quote the law which to me is so clear that I do not see how my contention can be questioned No member of the Fiscal Court shall be interested directly or indirectly or be concerned in any contract for work to be done or material to be furnished for the county or any district thereof nor purchase or be interested in any claim against the county or State Any member of the Fiscal Court who shall violate the provisions of this section shall upon conviction be fined not less than five hundred dollars nor more than five thousand dollars for each offense Kentucky Statutes chapter 52 section 1844 DAVIESS COUNTY vs GOODWIN Filed December 1 1903 1 Supervisor of roads Power to appoint County JudgeThe Fiscal Court of a county has no authority un der the statutes to appoint the County Judge of the county to the office of supervisor of roads and being a court of limited authority Its action in so doing is void 2 Same Action by taxpayerA taxpayer of the county suing for him self and all other taxpayers may maintain an action to prevent the payment to the County Judge of the salary of supervisor of roads These provisions do not contem plate that thesupervisorand the County Judgo may be the same person On the contrary they contemplate tIat the County Judge is to hold the supervisor to a strict responsibility and that to protect the interests of the county there must be the concurrent judgment of both the County Judge and super visor in important matters it IOLAKKI COUNTY VS SEARS Filed January 12 1904 Not to be re ported 1 RoadsPowers of Fiscal Court Wlieie the Fiscal Court of a county adopted a thanking the citizens of Richmond for their pres ence and liberal response at the mass meeting held at the Court House on Friday night This evidence of their appreciation of the institution is very gratifying to the inembershf the Association and insures a long life for the Infirmary Respectfully Mrs E M Hume Pres Association Mrs R L Gentry Pres Board of Managers ISlf Suit to be tiled The Lexington Leader of last Wed nes fay contained the following article According to a statement made hereby a prominent citizen of Richmond the Board of Trustees of the Central University of Kentucky nov located at Danville will be made defendants in a suit to be filed in the Madison Circuit Court this fall by the heirs of the late Col S P Walters on condition that the property would always hit used for educational purposes by tho trustees of the college but since the consolidation of the college at Richmond with Centre College at Danville and the school moved to the latter place the heirs of Col Walters believe that the trustees of the school have broken faith in the promises under which the land was accepted by them from the former wealthy Richmond banker The suit will be filed by Col W R Letcher of Richmond on behalf of his wife who is a daughter of the late Cot Walters and Was one of tho heirs of the vast estate left by him The property as it now stands is valued at 200000 as since the donation of the land by Col Walters tho ground was used for the erection of numerous buildings used fu connection with the college including eight handsome residences for the use of the professors a threestory dormitory several school buildings and a large gymnasium Resolutions Adopted by Richmond Conmandery Ho 19August 19 1904 The committee appointed to draw resolutions upon the death of Sir Knight James M Poyntz late a memo her of this Commandery reported the following which were unanimously adopted by a rising vote 1 That in the death of our honored and beloved associate we feel a deep sense of personal grief In his inter course with his brothers of the Temple he at all times manifested those Knightly and chivalrous courtesies which as a man a physician and a citizen so uniformly marked his con duct among the people of our town county and State 2 Sir Knight Poyntz was moreover a Christian gentleman faithfully dis charged all his obligations asa member and elder of his church and in all our circles the memory bf his virtues will long continue 3rd Nor will we soon forget that at lila funeral and burial In our cemetery his brethren of the medical fraternity nil united in marked tributes of respect that his fellow soldiers of the Confeder ate Army attested by their sorrowing presence their esteem for him asa brave and heroic friend and companion and that his Masonic brethren cordially unite with them in every demonstration of respect and sympathy for lily survi ving family and relatives Brother Sir Knight Povntz hail and IItew mC F Burnam J A IJIeim W R lIhaebJfOrd Cqiatseu II Mass lIIcdinIA large crowd of representative citizens of Richmond was present at the court house Friday evening in response to the call issued by time ladies of the Pattie A Clay Infirmary for a mass meeting to consider the advisability of continuing that institution for another year The meeting was railed to order by Judge J fl Chenault and on motion Mr Waller Bennett was unanimously chosen president and Mr Joe Schafhausen secretary The chair man stated that the City Council hay lug allowed only 400 for the mainte nance of this institution for the present year when formerly the city subsrib ed t6OO it would be necessary to raise subscriptiunpelled to close its doors Mr Bennett spoke of the superb management of the Institution and the untiring energy displayed by the lady managers to in our midst this greatest of Richmonds public benefactorsSpeeches endorsing this beneficent work were made by Judge J C Chen ault Messrs 0 C Wallace W L Crutcher R W Miller Rev J W Crates Rev EE Weaver Judge C H Breck and Senator G W Gates after which Mr W L Crutcher came forward with a subscription pap and recorded in less than twenty minutes 20i1 more than was requested to donate It is very gratifying to all friends of the Infirmary to know that onr citizens responded so liberally to this worthy cause and this feelingfornency In this junneclion the CLIMAX otTers this suggestion which we believe will for all time settle the contra versy that comes up annually belore the City Council for the appropriation for the maintenance of the Pattie A Clay Infirmary Let the ladies of the petitionsinbe held at the next municipal election to submit to the voters of the city of Richmond the proposition to give to the Infirmary Association a stated sum annually for the support of the institd tion and let the amount given become one of the fixed charges against the city thereby removing the annual request for the appropriation Such ac tion will not only he a great relief to tho ladies of the Infirmary but will remove an obligation from the City Council and will be conclusive evI- dence that the taxpayers of Richmond desire the maintenance of the Pattie A Clay
