Magistrial District sib ject to action of the Democratic party THAT CALEB POWKUS who is now posing before the people as a martyr of polilical enmity should have a fair and impartial trial and justice meted out to him accorJing to evidence secured or facts introduced no fair minded person will cavil or deny If he is guilty he should psy the pen alty piescribed by law If to the contrary he ii innocent of the charge then he should go free A great deal has been written and saidc concerning Powers different trials the manner in which they were conducted etc in fact the case has attracted wider publicity than any similar triali in the history of the nation And as political opinions differ individual opinion publicly expressed is die l vided But tho law does novpresumet to admit personal opinions or tihow political preference but deal with cold facts irrespective of parties persons or sexdNow let us look the matter squarely In the face If you will lay aside your prejudice and recall the scenes enacted at Frankfort before and after the assassination of Goebel you will have to deal with some very pertinent facts and facts that cannot be denied That Powers was a criminal ida lawbreaker has been proven beyond a pcradvcnture of a doubt It was mainly through his efforts that the civil law was supplanted by mob aw Ayers You can depend on Ayers Hair Vigor to restore color to your gray hair every time Follow directions and it never fails to do this work It stops Hair Vigor fallingof the hair also Theres great satisfaction in knowing you are not going to be disap pointed Isnt that so UtookYourIIaIrtgorIt A IkxJuAv llocklugLauiX C COAll1pvS or Fading Hair that he was the brains of the Republi can party during the Taylor regime must beadmitted that he was instru mental in rallying mob of moun taineers armed with deadly weapons and bringing them to Frankfort cannot be denied that he was active in sowing the seed of strife discord and violence instead of trying to bring about peace no one can question that he on the morning Goebel was assas sinated was on fleeting railway train manymiles from Frankfort bound for Louisville which accordingly viewed from the great speech he made in his own defense was merely a makeshift to detract public attention fromhis villainous work jind exonerate himself of the deeplaid plot that he by his untiring efforts instead of upholding the neutrality of the law and trying to bring justice to the front undermined the law and by sheer force relegated justice to the background is true that he was the henchman of Taylor we will have to admit that he accepted a pardon from Taylor as Governor fa advance of the assassination of Goebel who it must be ad mitted vas pursuing strictly legiti matepathstends further to strengthen the belief and is prima facia evidence that was the originator of a deep laid plot and was carrying into effect his campaign villainous warfare against the opponent and that he is an ac cessory before the fact for the crime for which he has been convicted in the ourts of the Commonwealth of Kentucky is imminent Since Powers arrest and imprisonment flimsy excuses and sicken ng sentimentalities have formed a compact against the real facts and he has been heralded to the nation as iving hero who is being sacrificed on he political pyre to satisfy the minds of a few bloodthirsty opponents Not only the Republican press of the State but of the nation has been loud in its enunciations and editorial columns have been teaming with disapprovals of Powers trials lie is lauded as a saint while those who conducted the trials are branded as tyrants gloating over an unfortunate subject But toe brief many men have been condemned by Courts aad paid the pen alty prescribed by law who by the side of Powers would shine in the grand galaxy of manhood like the sparkling rays of the sun as against the star of the dullest lustre And Qlearance SaleOF Wall Paper Is Now Ready The assortment of short ends single room patterns and broken combinations afford better choosing than those judgwentworkmanship coloring designs and quality The character of the papers offered in this sale is extremely high J not one word of protest was offered in their behalf So great fjfiitf been the walling s of the Republican party when jnlco seemed imminent barring sickening sentimentalitlesthat a precedent was established in this particular case The recent decision of United States District Judge Cochran to take juris diction in the case 61 Powers not only involves a serious legal question but likewise the public may ask will this trial be conducted with absolute fair ness and impartiality That Judge Cochran is greatly admired as a law yer a judge and a gentlemen of high standing by those who know him per sonally we will agree yet when we view the case in its many phases we fail to see where Judge Cochran has any legal right to take jurisdiction Furthermore Jpdge Cochran is a par tizan Republican and it is a logical presumption that a partisan spirit would dominate his court This is a question of serious concern that Powers friends cannot ignore but must meet face to face If they believe his tormer trials were unfair and that the decisions rendered were the outcome of partisan politics it is equally as fair to presume that the plaintiffs in the case in a Federal Court presided over by a Republican judge would not get justice Personally we have a very high regard for Judge Cochran but we doubt the legality of such juris diction and believe it will be piompt ly overruled it is ever considered by the United States Supreme Court Both the man murdered and his mar- Iderer were citizens of Kentucky am the trial of the murderer is Kentuckys special affair We believe the Courts of the Commonwealth arc equally fair and are able to handle their own business and also think it would be a vi elation of law an unfortunate prece dent if Federal Courts should be al towed to meddle GENERAL alarm is felt over the jol low fever situation at New Orleans The cases now number more than two hundred while there have been about fifty deaths The State of Mis
