Tbe County Attorney remarked that the air had been well charged for several day with a rumor that Judge McClure would be aworn oil pf the cas, and he hoped the Judge would Insist on an affi davit before he vacated the bench; that the prevention were willing for Judge McClure to preaide in the rae even though he was a witness for the defense. Judge McClure then announced that ifthede fendants objected to his trying the ca they must file their affidavit and follow the course prescribed by law. Tbe affi davit waa at once made and presented. A new court was orgsuiied Immediately, confuting of 'Squires A. J. Pike and II D, Burnett. The County Attorney alsted that he had no power to object to 'Squire Pike, but that relatives of the deceaicd preferred that he would not sit in the caae, 'Squire Pike dceired ts withdraw from tbe caae, but the defendants' attorneys insisted that be sbould remain. He finally con sented lo slay In the case. It is generally believed that the Court will do what is right. The defendants filed an affidavit asking for a continuance of the case, which wss grsnted, The trial wss set for yester day(Tbursday), and it wss expected that it would certainly begin as soon as the Court convened. Since the adjournment of Court on Tuesday, Col. W.G. Welch and Judge M.CSaufiey, of Stanford, have been em ployed lor the prosecution, lliey came np Wednesday evening.
